Temporary Mobile Toilet Rental Contract
The temporary mobile toilet rental contract should include the following core elements to ensure the rights and interests of both parties and comply with legal requirements:

I. Contract Parties and Basic Terms The contract should clearly state the names (or full names of the entities) of Party A and Party B and indicate that it is signed in accordance with the Civil Code of the People's Republic of China (the former Contract Law has been repealed) and relevant regulations. The purpose of the contract is for Party B to rent temporary mobile toilets provided by Party A. The specific location of the rented items (such as the address of the event venue or construction site), model specifications, and quantity (subject to the confirmation list by both parties) should be specified, and the intended use (such as exhibitions, concerts, construction projects, etc.) should be limited to prevent out-of-scope use.
II. Rental Period and Renewal Rules The start and end dates (e.g., 'From [Date] to [Date] in 2024') should be clearly defined, and the conditions for renewal should be agreed upon: Party B should submit a written application [X] days before the expiration of the contract, and a new contract should be signed after Party A's approval. This clause can prevent disputes caused by ambiguous terms.
III. Fee Standards and Payment Methods
- Rent: The unit price should be agreed upon on a case-by-case basis, for example:
- For 15 days or less: [X] yuan per toilet per day;
- For more than 16 days: [X] yuan per toilet per day;
- Or monthly payment: [X] yuan per toilet per month.
- Payment Method: It can be agreed that the initial rent (e.g., 50%) should be paid within [X] days after the contract is signed, and the remaining balance should be paid in full after the event ends; or payments can be made on a daily/monthly/quarterly basis, and the payment method (cash or bank transfer) should be clearly specified.
- Deposit: Party B should pay a deposit of [X] yuan. After the expiration of the rental period, Party A should refund the remaining amount without interest after deducting fees for damages, losses, etc.
IV. Rights and Obligations of Both Parties
- Obligations of Party A:
- Provide mobile toilets that meet national quality standards and ensure legal business qualifications;
- Be responsible for transportation, installation, commissioning, and daily maintenance and upkeep to ensure the normal operation of the toilets;
- Regularly clean and disinfect the toilets, and the sanitation standards should comply with local regulations (such as the Public Toilet Sanitation Standards).
- Obligations of Party B:
- Pay the rent and deposit on time and in full;
- Use the toilets reasonably and not alter the structure or damage the facilities without authorization;
- Keep the area around the toilets clean and prohibit the随意丢弃 (random disposal) of waste;
- Supervise Party A's maintenance work and notify Party A promptly if any problems are found.
V. Liability for Breach of Contract and Dispute Resolution
- Liability for Breach of Contract:
- If Party A fails to provide the toilets as agreed, it should pay a penalty and compensate Party B for losses;
- If Party B fails to pay the fees on time, it should pay a penalty and bear Party A's losses;
- If Party B alters the structure of the toilets without authorization, it should pay compensation and bear the repair costs.
- Dispute Resolution: Priority should be given to negotiation for resolution; if negotiation fails, a lawsuit can be filed with the people's court at Party A's location in accordance with the law, or the case can be submitted to an arbitration committee for arbitration (the name of the arbitration institution should be specified).
VI. Contract Termination and Supplementary Terms
- Both parties can terminate the contract by mutual agreement; if the contract cannot be performed due to force majeure (such as natural disasters or policy adjustments), both parties should resolve the issue through negotiation.
- Matters not covered herein can be covered by a supplementary agreement, which shall have the same legal effect as this contract; the contract shall be made in duplicate, with each party holding one copy, and shall take effect from the date of signature or seal.
