Mobile Toilet Rental Contract

Admin October 08, 2026

A mobile toilet rental contract typically includes core elements such as contract parties, rental duration and fees, service responsibilities, special clauses, breach handling, and supplementary terms for effectiveness, with specific clauses adjusted according to actual needs.

I. Contract Parties and Basic Information
The contract must clearly specify the full names, addresses, contact details, and legal representatives (if applicable as enterprises) of both parties to ensure legal validity. The description of the leased item should be detailed, including the model of the mobile toilet (e.g., single-unit or connected-unit), specifications (size, capacity), quantity, and an equipment list (e.g., water tank, sewage pipe, ventilation system). Some contracts require this list to be attached as an annex and signed by both parties for confirmation.

II. Rental Duration and Fees

  1. Duration: Short-term rentals are charged per day, with clear start and end dates specified (e.g., "from the date of delivery of the equipment to the location designated by Party B"). Long-term rentals may specify a fixed term or "until the date of termination agreed upon by both parties," with renewal conditions noted.
  2. Rent and Payment: Short-term rents may be tiered (e.g., 620 yuan per unit per day for up to 15 days, 580 yuan per unit per day beyond 15 days). Long-term rents are paid monthly or annually, with payment dates (e.g., by the 5th of each month) and methods (bank transfer) specified. Party B must retain payment receipts, and Party A must issue invoices.
  3. Deposit: Party B pays a deposit upon signing the contract (usually equivalent to 1-3 months' rent), which is fully refundable upon lease expiration if no damage occurs; otherwise, repair costs are deducted before refund.

III. Service Content and Responsibility Allocation

  1. Party A's Responsibilities: Transport, install, and commission the equipment at Party B's designated location; conduct regular maintenance (e.g., twice-weekly inspections, replacement of consumables) to ensure proper operation; and clean and disinfect according to hygiene standards (e.g., twice-weekly professional deodorization).
  2. Party B's Responsibilities: Use the equipment reasonably, without unauthorized modification or structural damage; clear obstacles at the installation site in advance to facilitate Party A's operations; and assume custody obligations during the lease, compensating at market value for damage or loss.

IV. Special Clauses

  1. Position Adjustment: Party B may relocate the mobile toilet within the same construction site but must notify Party A in advance to adjust cleaning routes.
  2. Subletting Restrictions: Party B may not sublet or relocate the equipment to another site without Party A's written consent.
  3. Settlement Rules: Leases under 15 days are charged on a half-month basis; those exceeding 15 days are settled on a full-month basis. Early termination of long-term leases requires payment of a penalty (e.g., 20% of the remaining rent).
  4. Force Majeure: If the contract cannot be fulfilled due to natural disasters, policy changes, or other force majeure events, both parties shall negotiate contract termination or extension.

V. Breach and Dispute Resolution

  1. Breach Liability: If Party A fails to provide equipment or maintenance as agreed, it must compensate Party B for direct losses. If Party B delays rent payment, a daily late fee of 0.5% is imposed; damage to equipment requires payment of repair costs and penalties.
  2. Dispute Resolution: Priority is given to negotiation; if unresolved, litigation may be initiated in the court of Party A's location.

VI. Contract Effectiveness and Supplements
The contract takes effect upon signature and sealing by both parties, with two copies distributed equally. Unaddressed matters may be covered by supplementary agreements, which hold equal legal force with this contract.
