Sanya Prefabricated House Demolition Regulations
The regulations for the demolition of prefabricated houses in Sanya are primarily implemented in accordance with the 'Rules for the Demolition of Expropriated Buildings and Structures', with the following key points:

Scope of Application
The demolition of prefabricated houses must meet two types of conditions: first, when the expropriated rights holder has signed an expropriation compensation and resettlement agreement, the expropriation implementation unit shall legally demolish the house, its above-ground attachments, and structures; second, when the expropriated rights holder refuses to sign the agreement or their eligibility is unclear, the expropriation unit shall legally carry out compulsory demolition measures. These rules cover all expropriated buildings, including prefabricated houses, but do not establish separate provisions for the particularities of prefabricated structures.
Negotiation and Policy Explanation
The expropriation implementation unit (Tianya District Project Promotion Service Center) needs to negotiate with the expropriated rights holder and arrange for staff to be present. Staff members must familiarize themselves with the compensation plan for their respective areas in advance and accurately explain the policy content, preliminary verification status, and details of this compensation and resettlement, while retaining records of the discussions. Making commitments that exceed the policy framework is strictly prohibited to ensure uniform and transparent compensation standards.
House Handover Process
The expropriation implementation unit is responsible for organizing the handover of the house, urging the expropriated rights holder to deliver the house and its attachments within the agreed timeframe, and assisting in the cancellation of property rights documents. After delivery, both parties sign a 'House Handover Confirmation' as a prerequisite for demolition. If the house is not handed over after compensation, unless otherwise agreed in the agreement, the expropriation unit may revoke relocation incentives (such as rewards for active cooperation) to ensure the progress of the expropriation.
Demolition Implementation and Supervision
The expropriation unit needs to select a qualified demolition unit through an open procedure, sign a委托 (entrustment) contract, and specify the project timeline. During the demolition process, the expropriation unit needs to supervise the entire process, focusing on urging the construction unit to implement safety measures (such as fencing and dust screens) and civilized construction requirements (such as noise control and waste removal) to avoid impacting the surrounding environment and residents.
Other Notes
In the 'Expropriation Compensation Plan for the JBZ-TY-YCYL01 Plot of the Sanya Ready-Mixed Commercial Concrete Mixing Station' issued by the Tianya District People's Government of Sanya, although it is clearly stated that the expropriation subject is the district government and the implementation unit is the project promotion service center, no special provisions for the demolition of prefabricated houses have been supplemented. In actual operation, the 'Demolition Rules' shall prevail.
