Mobile Toilet on Rooftop

Admin October 13, 2026

Setting up a mobile toilet on the rooftop is an unauthorized construction activity without planning approval and may be illegal.

Illegal Nature

The rooftop terrace belongs to the common public area of all homeowners in the residential community, not private space for individuals. According to relevant regulations, any unauthorized construction or renovation activities without planning approval are considered illegal constructions. Setting up a mobile toilet on the rooftop without obtaining any construction planning approval constitutes an illegal construction activity and is suspected of violating the relevant provisions of Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China. For example, on August 20, 2026, the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District received a tip-off about suspected illegal construction on the rooftop of a residential building in their jurisdiction. Upon investigation, it was found that the resident had unauthorizedly built two aluminum alloy glass sunrooms and illegally installed a mobile toilet on the rooftop terrace. All these construction facilities had not obtained any construction planning approval and were identified as illegal constructions.

Safety Hazards

When a mobile toilet is placed close to the edge of the rooftop terrace, there is an obvious risk of it falling from a great height. Due to its structural characteristics, in the event of strong winds or external impacts, it may fall from the rooftop, causing serious harm to pedestrians and vehicles below and posing a threat to public safety.

Suitable Scenarios for Mobile Toilets

Mobile toilets are generally composed of a fecal sewage storage tank (or fecal sewage treatment device), flooring, sanitary ware, walls, washing facilities, water tanks, roofs, and mobile devices. They are typically suitable for stations, docks, tourist attractions, villa areas, newly built residential communities, large construction sites, squares, densely populated public places, and bustling commercial streets. However, these suitable scenarios do not include public areas like rooftop terraces. Setting up a mobile toilet on the rooftop does not comply with its conventional usage norms and planning requirements.
