Is It Legal to Renovate a Mobile Toilet?

Admin September 27, 2026

Whether it is legal to renovate a mobile toilet depends on the specific circumstances. If it involves unauthorized alteration of the property's intended use or violation of relevant renovation regulations, it may be illegal.

Unauthorized Alteration of Property Use May Be Illegal

According to Article 58, Paragraph 1 of the 'Shanghai Residential Property Management Regulations', property owners and users shall use the property in accordance with the purpose approved by the planning administrative department or stated in the real estate ownership certificate, and shall not alter the property's intended use without authorization. If renovating a mobile toilet involves converting a room or balcony without waterproofing into a bathroom, this constitutes an unauthorized alteration of the property's intended use and violates relevant regulations. Once discovered, one may face penalties including an order to make corrections within a specified time limit and restore the original state, as well as a fine ranging from 10,000 to 50,000 yuan.

Violation of Residential Interior Decoration Management Regulations

According to Article 5 of the 'Measures for the Administration of Residential Interior Decoration', residential interior decoration activities are prohibited from converting rooms or balconies without waterproofing requirements into bathrooms or kitchens. If the renovation of a mobile toilet involves such alterations, it violates these administrative measures. This kind of violation may not only affect one's own living safety but also have adverse effects on the surrounding environment and other property owners.

Liability for Endangering Building Safety or Damaging Other Property Owners' Rights

If the act of renovating a mobile toilet endangers the safety of the building or damages the legitimate rights and interests of other property owners, such as causing water leakage or wall cracking, according to Article 272 of the 'Civil Code', property owners shall not exercise their rights in a manner that endangers the safety of the building or damages the legitimate rights and interests of other property owners. The violator shall be responsible for removing obstacles, eliminating dangers, restoring the original state, and compensating for losses. This will not only bring financial losses to the violator but may also trigger neighborhood disputes and affect the harmonious living atmosphere.
