Private Construction of Container Houses

Admin September 15, 2026

The private construction of container houses generally constitutes illegal building behavior. Determining whether it is illegal requires considering factors such as its purpose, construction location, and approval procedures. Details are as follows:

Unauthorized Construction Without Approval is Illegal

If container houses are used for temporary living, office purposes, etc., and are constructed without obtaining legal approval in accordance with relevant regulations in non-planned construction areas, such as urban public green spaces, roadsides, or private land without land use permits, they may constitute illegal buildings. For example, on the expropriated state-owned land in Zhenwushan Group, Qiaotoubian Village, Guanyinqiao Subdistrict, Qixingguan District, Bijie City, there were cases of unauthorized placement of containers and private construction of houses without approval from relevant departments, violating land management and urban appearance regulations, and posing safety hazards. Relevant departments ordered a deadline for cleanup and removal.

Legal and Compliant Construction is Not Illegal

If container houses are constructed in accordance with regulations on legally compliant sites, such as approved construction land, for legitimate purposes like warehousing and logistics, and relevant permits are obtained, they do not constitute illegal buildings.

Illegal Construction Poses Many Risks

Privately constructed container houses often pose fire safety hazards. Some temporary buildings on construction sites and illegal structures of some enterprises use flammable materials such as polystyrene and polyurethane foam for the core materials to save costs. These flammable and combustible sandwich materials have poor fire resistance and safety. Electrical welding sparks and cigarette butts can ignite these materials, which burn rapidly and produce toxic combustion products. In addition, illegal construction may also affect urban appearance, occupy public spaces, and damage the surrounding environment.
