Outdoor Rooftop Home Portable Toilet
It is illegal and non-compliant to privately build a home portable toilet on the rooftop of a residential community, and such actions should not be carried out.

Nature of Rooftop Space
The rooftop belongs to the public space of the residential community, and its ownership is jointly held by all the property owners, rather than being the private area of a single property owner. This means that no property owner can arbitrarily occupy or renovate the rooftop space and must comply with relevant laws, regulations, and the management rules of the community.
Illegality of Private Construction
According to relevant regulations, any unauthorized private construction is strictly prohibited, and this explicitly includes portable toilets. For example, on August 20, 2026, the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District received a tip-off about suspected illegal construction on the rooftop of a residential building in the jurisdiction. After investigation, it was found that the resident had擅自 (unauthorizedly) built two aluminum alloy glass sunrooms on the rooftop terrace and illegally set up a portable toilet. Moreover, none of the above-mentioned construction facilities had undergone any construction planning approval procedures and were ultimately identified as illegal construction. This fully demonstrates that even seemingly simple actions like setting up a portable toilet are considered illegal construction if they have not gone through the legal approval process.
Consequences of Illegal Construction
Once identified as illegal construction, the party involved needs to bear corresponding legal responsibilities. In the above-mentioned case, the party involved voluntarily promised to dismantle all illegal construction by August 25. If they fail to do so voluntarily, the relevant departments have the right to take measures such as forced demolition, and the party involved may also face other penalties such as fines. At the same time, illegal construction also has a negative impact on the overall environment and order of the community, triggering conflicts and disputes among neighbors and undermining the harmonious community atmosphere.
Therefore, in order to comply with laws and regulations and safeguard the public interests of the community and a good living environment, property owners should not privately build home portable toilets on the rooftop.
