Mobile Toilets and Urban Management

Admin September 28, 2026

It is illegal for urban management departments to lease mobile toilets to vendors as shops without authorization; however, using them for public purposes through legal procedures is in compliance with regulations.

Unauthorized Change of Purpose by Urban Management Departments May Constitute a Violation of the Law

Mobile toilets are public facilities in urban management, typically allocated by the government to meet sanitation needs in public places and safeguard public health and convenience. As the law enforcement agency for urban management, urban management departments are responsible for maintaining urban order and managing public facilities. However, they must exercise their powers in accordance with laws and regulations and must not arbitrarily change the purpose of public facilities or use them for non-public purposes. If urban management departments lease mobile toilets to vendors as shops without authorization, this clearly changes the purpose of the public facilities, violating the original intention of government allocation and relevant laws and regulations, such as the "Measures for the Administration of Urban Management Law Enforcement in the People's Republic of China". Even if urban management departments sign a lease contract with vendors, the contract may be deemed invalid due to the violation of mandatory provisions of laws and regulations (such as the prohibition on arbitrarily changing the purpose of public facilities).

Can Be Used for Public Purposes Through Legal Procedures

In specific scenarios, urban management departments can use mobile toilets through legal procedures. For example, the Kunming Urban Management Bureau leased mobile public toilets through government procurement services to meet the toilet needs of citizens and tourists during the 10th China-South Asia Expo, thereby enhancing the city's image. Such actions strictly adhere to government procurement regulations and ensure that the purpose of the facilities aligns with public interests, making them legal and reasonable.

Vendors Should Carefully Evaluate the Legality of Leasing

For vendors, if they intend to lease mobile toilets as shops, they must carefully evaluate the legality. Since mobile toilets are public facilities with strictly limited purposes, vendors who use them without authorization may face risks such as eviction or fines. Therefore, vendors should fully understand relevant laws, regulations, and policy requirements before leasing to ensure that their actions are legal and compliant.
