Is Prefabricated Assembled Housing Legal?

Admin September 18, 2026

The legality of prefabricated assembled housing (prefabricated housing) needs to be comprehensively judged based on specific scenarios and regulatory requirements. It is legal if it complies with the regulations; otherwise, it may be illegal.

I. Construction Activities Must Be Carried Out in Accordance with the Law As a form of housing construction, the construction activities of prefabricated housing are governed by the Construction Law of the People's Republic of China. This law clearly defines that construction activities include the construction of housing buildings and their ancillary facilities. Therefore, the construction of prefabricated housing must be carried out in accordance with the law, and its purpose or planning scope must not be changed without authorization. For example, when constructing prefabricated housing in urban planning areas, it is necessary to strictly comply with the requirements of the Construction Law regarding construction qualifications and safety standards.

II. Compliance with Construction Standards and Quality Management Requirements is Necessary According to the Regulations on the Quality Management of Construction Projects, construction units must carry out construction in accordance with engineering design drawings and construction technical standards, and it is strictly prohibited to modify the design or cut corners without authorization. The construction of prefabricated housing must adhere to strict quality management standards to ensure the structural safety and functionality of the housing. For example, the connection nodes and seismic performance of prefabricated components must pass professional testing and comply with national standards before they can be put into use.

III. Compliance in Production and Inspection Processes is Required In accordance with Article 29 of the Regulations on the Quality Management of Construction Projects, construction units are required to inspect construction materials and components. All materials and components used in the production process of prefabricated housing must pass inspection before they can be used. For example, prefabricated wall panels and floor slabs must be provided with quality certificates to avoid safety hazards caused by material problems.

IV. Complete Planning and Construction Permits are Necessary When constructing prefabricated housing in urban or town planning areas, it is necessary to apply for a construction project planning permit from the competent department of urban and rural planning. If it is a temporary construction, approval must be obtained and it must be demolished within the specified time limit. For example, when constructing prefabricated housing on rural collective land, it is necessary to comply with village planning and obtain a rural construction planning permit; otherwise, it may constitute illegal construction.

V. Land Use Must Be Legal The land used for the construction of prefabricated housing must comply with the provisions of the Land Administration Law of the People's Republic of China. For example, rural residents' housing land must legally obtain the right to use homestead land, and the construction of township enterprises and public facilities must go through land approval procedures. Constructing prefabricated housing on land without approval may involve illegal land occupation and other illegal acts.

VI. Approval Procedures Must Be Followed for Rural Self-Occupied Housing Rural self-occupied prefabricated housing is not illegal in itself, but it is necessary to legally obtain homestead land and go through the housing construction approval procedures, using qualified prefabricated components. If construction is carried out without approval or materials that do not meet safety standards are used, it may violate regulations such as the Urban and Rural Planning Law and building safety management regulations.
