Hanchuan Prefabricated Panel House

Admin September 18, 2026

The demolition and reconstruction of prefabricated panel houses in Hanchuan need to be judged based on specific circumstances, with no unified policy. It is necessary to follow legal procedures and meet specific conditions.

I. Core Conditions for Demolition and Reconstruction

  1. Building Safety Rating: If a prefabricated panel house is identified as a Grade D dilapidated building by a professional institution (e.g., foundation settlement exceeding 5 cm or cracks in load-bearing walls exceeding 1 mm), or if its seismic resistance rating is below 70% of the current standard, it must be demolished and rebuilt. Such identification requires a quantitative assessment report issued in accordance with the Standard for Seismic Appraisal of Buildings (GB50023-2009).
  2. Adjustment of Planned Use: If the house is located within a municipal engineering planning area, commercial development zone, or industrial land red line (e.g., parts of Wangji Village in Hanchuan City have been designated for industrial land development) and does not conform to the new planned use (e.g., residential properties), it must be demolished after compensation through the expropriation process.
  3. Renovation of Old Houses: If the house is merely old but has no structural safety hazards, the focus should be on renovation and upgrading, including elevator installation, facade repair, pipeline replacement, etc., rather than direct demolition.

II. Special Circumstances in Wangji Village, Hanchuan City

According to the announcement Chuan Yu Zheng Di Gao [2024] No. 2 issued by the Hanchuan Municipal People's Government, part of the land in Wangji Village is planned for industrial land development, but the announcement does not explicitly mention the demolition and reconstruction of prefabricated panel houses. If a future expropriation announcement is issued, it must comply with the public interest provisions of Article 45, Paragraph 5 of the Land Administration Law and fulfill legal procedures such as land status surveys and surveys of the basic conditions of affected farmers. Houses outside the red line must be individually assessed for compliance with the three priority demolition conditions; otherwise, they must not be handled without authorization.

III. Legal Risks of Unauthorized Demolition and Reconstruction

From the date of the expropriation announcement, activities such as rush planting, rush construction, and rush building within the proposed land expropriation area are prohibited; otherwise, no compensation or resettlement will be provided. Any unauthorized demolition or reconstruction without approval is illegal and may result in legal liabilities, including forced restoration to the original state and fines.

IV. Legal Process for Demolition and Reconstruction

  1. Application Submission: Submit a demolition and reconstruction application to the village committee, attaching originals and copies of your ID card, household registration book, and homestead certificate. Clearly specify the demolition and reconstruction area (which must not exceed the original homestead area) and the number of floors (not exceeding 3 floors).
  2. Review and Public Announcement: The village committee shall complete the preliminary review and make a public announcement within 7 working days, verifying whether the homestead ownership is clear and whether it complies with the "one household, one homestead" principle.
  3. Township Approval: The township government shall complete an on-site inspection within 15 working days to review compliance with the township's territorial spatial planning and whether it affects neighboring rights and interests. Upon approval, it shall issue a Rural Construction Planning Permit and a Homestead Approval Certificate.
