Floor Mobile Toilet Regulations

Admin September 24, 2026

The regulations for floor mobile toilets need to be comprehensively considered from three aspects: building structure, housing usage functions, and adjacent relationships, as detailed below:

I. Scenarios involving changes to the building structure
If the installation of a mobile toilet requires modifications to the main building or load-bearing structures (such as wall removal, floor slab perforation, etc.), strict compliance with Article 15 and Article 69 of the 'Regulations on the Administration of Construction Project Quality' is mandatory. Such projects must have design plans proposed by the original design unit or a design unit with the corresponding qualification level; otherwise, construction shall not proceed without authorization. In case of violations, individuals will face fines ranging from 50,000 to 100,000 yuan, while units will be subject to fines between 500,000 and 1,000,000 yuan, along with the immediate requirement to rectify and restore the original state.

II. Changes involving housing usage functions
According to Article 5 of the 'Measures for the Administration of Interior Decoration and Renovation of Residential Buildings,' it is prohibited to convert rooms without waterproofing requirements (such as bedrooms and living rooms) into bathrooms. If the installation of a mobile toilet involves such functional changes, it constitutes an illegal act. Violators will be ordered to make corrections by the urban real estate administrative department, with fines ranging from 500 to 1,000 yuan imposed on the renovator and fines between 1,000 and 10,000 yuan on the decoration and renovation enterprise. This regulation aims to prevent water leakage caused by a lack of waterproofing, which could damage the rights and interests of owners on lower floors.

III. Management of adjacent relationships
In accordance with Article 288 of the 'Civil Code,' adjacent right holders of real estate should handle adjacent relationships following the principles of facilitating production, convenience for daily life, and unity and mutual assistance. If the installation of a mobile toilet on an upper floor causes issues such as water leakage, odors, or noise, affecting the normal life of owners on lower floors, the latter have the right to request the cessation of the infringement, restoration to the original state, or compensation for losses. Additionally, if the property management regulations of the residential community explicitly prohibit unauthorized changes to the building structure or usage, the installation of the mobile toilet may simultaneously violate these regulations, and the property management company has the right to request the owner to restore the original state or take other remedial measures.

Summary: The installation of floor mobile toilets must be based on legal compliance, requiring professional design for structural changes, compliance with waterproofing requirements for functional changes, and no infringement on adjacent rights. It is recommended that owners consult with property management, design units, and legal professionals before installation to ensure compliance with all regulations and avoid disputes.
