Tax Rate for Container House Sales

Admin September 15, 2026

The value-added tax (VAT) rate for container house sales depends on the identity of the seller and the nature of the business. For general taxpayers, the rate is 13%, while for small-scale taxpayers, the levy rate is 3% (with possible concessions during the pandemic).

I. Core Basis for VAT Rates

According to the case of the VAT rate applicable to container leasing in international freight, when general taxpayers sell or lease container houses (classified as goods sales or tangible movable property leasing), the VAT rate is 13%. Small-scale taxpayers, on the other hand, are subject to a levy rate of 3% (which may be reduced to 1% during the pandemic, subject to the latest policies). This rule also applies to the sale of container houses, as it essentially falls under the category of goods sales.

II. Applicable Tax Rates in Special Scenarios

  1. Sales of Second-Hand Container Houses If the seller is a general taxpayer and has deducted input tax when purchasing the house, output tax must be calculated at a 13% rate. If input tax has not been deducted (e.g., if eligible for simplified tax calculation), VAT may be paid at a reduced rate of 2% of the 3% levy rate (subject to registration with the tax authorities).

  2. Concessions for Small-Scale Taxpayers Under current policies, small-scale taxpayers with monthly sales not exceeding RMB 100,000 (or quarterly sales not exceeding RMB 300,000) are exempt from VAT. Sales exceeding this threshold are subject to a 1% levy rate (with the concession period extending to December 31, 2027). If the sale of container houses meets these conditions, exemption or a low tax rate may be applicable.

III. Potential Impact of Other Taxes

  1. Corporate Income Tax Income from the sale of container houses must be included in the taxable income of enterprises and is subject to a 25% corporate income tax rate (with preferential rates available for high-tech enterprises, etc.).

  2. Individual Income Tax If the seller is an individual, individual income tax must be paid on the "income from property transfer" at a rate of 20%, with the taxable amount being the balance of the transfer income after deducting the original value of the house and reasonable expenses.

IV. Operational Recommendations

  1. Clarify Taxpayer Identity: Before selling, confirm whether you are a general taxpayer or a small-scale taxpayer to determine the applicable tax rate.
  2. Stay Updated on Policies: VAT rates may change due to policy adjustments. It is advisable to obtain the latest information through the official website of the tax authorities or professional institutions.
  3. Issue Invoices in Compliance: Issue VAT invoices at the actual tax rate or levy rate to avoid tax risks.
