Container House Related Policies
Admin September 15, 2026
The legality of building container houses in rural areas needs to be discussed on a case-by-case basis, with the key being whether legal procedures are obtained and planning requirements are met.

I. Legal Situations
- Compliant Construction on Homestead Land If a container house is built on legally acquired homestead land, complies with the overall land use plan of the township (town) and village plan, and does not occupy permanent basic farmland, it is generally considered legal. For example, container houses used solely for temporary storage and without hardened ground or connected utilities are not regarded as illegal structures in some areas.
- Temporary Buildings Allowed by Policies In some regions, container houses are permitted as temporary structures, but an application must be submitted to relevant departments, specifying the purpose, duration, etc., and approval must be obtained before placement. For instance, cities like Shanghai and Shenzhen encourage the use of container buildings in the cultural tourism and commercial sectors, but land use approval and planning filing procedures must be completed.
II. Illegal Situations
- Lack of Planning Permission If a container house has not applied for or obtained planning permission and has not obtained land use rights certification, it may be considered an illegal structure even if the land nature has not been changed. For example, placing container houses in basic farmland or ecological protection zones, or using them for commercial purposes (such as homestays or shops) without obtaining fire safety permits and other procedures.
- Substantial Change in Land Use If a container house has a concrete foundation poured, is connected to utilities for long-term residence, or is converted for commercial purposes (such as homestays or shops), it may be considered a substantial change in land use and face the risk of demolition. For example, a company in Hangzhou legally built staff dormitories using containers after obtaining approval for prefabricated building construction; however, if the construction procedures were not followed, it might be forcibly demolished.
III. Compliance Recommendations
- Consult Policies in Advance Before construction, consult with local planning and land departments to clarify whether container houses are allowed as temporary or permanent structures.
- Complete Necessary Procedures If policies permit, complete procedures such as obtaining a rural construction planning permit and land use certificate, and ensure that the container house meets building safety, fire safety, and other requirements.
- Avoid Sensitive Areas Stay away from sensitive areas such as basic farmland and ecological protection zones, and prioritize placing container houses in commercial/cultural tourism land or permitted areas.
