Small Rooftop Mobile Toilet
Setting up a small mobile toilet on the rooftop without obtaining approval is considered an illegal construction act.

Illegal Construction Case
On August 20, 2026, the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District received a tip-off about suspected illegal construction on the rooftop of a residential building in the jurisdiction. After investigation, it was found that the resident had unauthorizedly built two aluminum alloy glass sunrooms on the rooftop terrace and illegally installed a mobile toilet. Moreover, none of the construction facilities had obtained any construction planning approval, which constituted an illegal construction act and was suspected of violating the relevant provisions of Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China. This indicates that setting up a mobile toilet on the rooftop without obtaining approval in accordance with laws and regulations will lead to the determination of illegal construction.
Composition and Classification of Mobile Toilets
Mobile toilets generally consist of a fecal sewage storage tank (or fecal sewage treatment device), flooring, sanitary ware, walls, washing equipment, water tanks, roofs, mobile devices, etc. There are various classification methods. According to the structural form, they can be divided into single-structure mobile toilets and composite-structure mobile toilets; according to the mobility method, they can be divided into hoisting and handling mobile toilets, powered and towed mobile toilets; according to the sewage treatment method, they can be divided into water-flushing and waterless suction mobile toilets, circulating water-flushing mobile toilets, and dry-packing mobile toilets.
Legal Setup Requirements
Although mobile toilets have various types and characteristics, when setting them up on the rooftop, it is necessary to obtain approval in accordance with laws and regulations. This is because the rooftop is a public area or a specific space of the building, and its use and construction are strictly regulated by laws and regulations. Unauthorized installation of a mobile toilet without approval may not only affect the structural safety and overall appearance of the building but also have an impact on the surrounding environment and the lives of other residents. Therefore, if there is a genuine need to set up a mobile toilet on the rooftop, one should consult the relevant departments in advance and go through the approval procedures to ensure that the setup is legal and compliant and avoid facing disposal measures such as demolition.
