Roof-mounted Mobile Toilet

Quản trị 22 tháng 9, 2026

Installing a mobile toilet on the roof without approval is an unauthorized construction activity and is illegal.

Legal Aspect

The rooftop terrace belongs to the public space of the residential community. According to relevant laws and regulations, any unauthorized construction activities are strictly prohibited. In accordance with the first clause of Article 40 of the Urban and Rural Planning Law of the People's Republic of China, for the construction of buildings, structures, roads, pipelines, and other engineering projects within urban and town planning areas, the construction unit or individual shall apply to the urban and rural planning administrative department of the city or county government, or the town government designated by the people's government of the province, autonomous region, or municipality directly under the Central Government, for a construction project planning permit. If no such construction planning approval has been obtained for installing a mobile toilet on the roof, it constitutes an illegal construction activity. For example, in a case handled by the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District, a resident installed a mobile toilet on the rooftop terrace without obtaining any construction planning approval, which was suspected of violating this legal provision.

Public Resources Aspect

Such illegal constructions encroach upon the public resources of the residential community. The rooftop terrace, as a public space, should be jointly used and enjoyed by all property owners. Installing a mobile toilet privately occupies this space, preventing other property owners from using it normally and damaging the public interests of all property owners.

Safety Risk Aspect

There are numerous safety risks. On the one hand, it may lead to the problem of falling objects from high altitudes. If the mobile toilet and its ancillary facilities are not firmly fixed, they may fall from the rooftop under adverse weather conditions, posing a serious threat to the people and property below. On the other hand, it can cause structural overloading. The rooftop terrace is designed with a certain load-bearing standard. Installing a mobile toilet privately increases the load on the rooftop, which may affect the structural safety of the building. Over time, it may even lead to cracks, deformations, and other problems in the building, endangering the lives and property of the residents of the entire building.
