Is Demolition of Prefabricated Panel Houses Illegal?

Quản trị 19 tháng 9, 2026

Whether the demolition of prefabricated panel houses is illegal depends on specific circumstances and cannot be generalized.

Ownership and Nature of the Act Affect Legality

If the prefabricated panels belong to the common parts of a building, such as the separating wall between two households or commonly used structural parts, according to the law, the ownership of the common parts is jointly held by all owners. Demolishing them without the consent of other co-owners constitutes an infringement on common property and is illegal. If the prefabricated panels belong to the exclusive part of one party, for example, those installed by a certain household within its exclusive space, that party has the right to decide whether to demolish them. However, the demolition must not affect the normal use and safety of other owners. If the demolition causes damage to the interests of other owners, the demolishing party shall be liable for compensation. In addition, if the ownership of the prefabricated panels is unclear, unauthorized demolition may lead to legal disputes. In this case, it is necessary to clarify the ownership through legal means before deciding on demolition.

House Type and Policy Basis Affect Legality

According to relevant notices from the Ministry of Housing and Urban-Rural Development, dilapidated prefabricated panel houses in cities, due to their short service life and poor quality, not only affect the quality of life of residents but also the city's image. They fall into the category of building types that do not meet urban development and construction requirements. Such houses will be included in the scope of demolition and reconstruction. However, such demolitions must comply with urban renewal policy requirements, such as limiting the demolition area and increasing the proportion of on-site resettlement. Only when these policy requirements are met can the demolition be legal and compliant.

Illegal Demolition Entails Legal Consequences

If the demolition act is illegal, the demolishing party may be required to bear various legal responsibilities. In terms of civil liability, they may have to stop the infringing act, restore the house to its original state, and compensate for the losses caused. In serious cases, if the demolition act constitutes the crime of intentional destruction of property, they may also face criminal liability and be severely punished by law.
