Who is Responsible for the Collapse of a Prefabricated Panel House

Quản trị 19 tháng 9, 2026

The attribution of responsibility for the collapse of a prefabricated panel house needs to be comprehensively judged based on specific circumstances and may involve multiple parties, including the construction unit, construction company, design unit, supervision unit, property owner, or user of the house. Each responsible party should bear corresponding legal liability based on the degree of their fault.

Responsibilities of the Construction Unit and Construction Company

According to Article 1252 of the Civil Code of the People's Republic of China, if the collapse or subsidence of a building, structure, or other facility causes harm to others, the construction unit and construction company shall bear joint and several liability, unless they can prove that there are no quality defects. After the construction unit and construction company have made compensation, if there are other responsible parties, they have the right to seek compensation from those parties. If the construction unit violates statutory construction procedures, such as failing to conduct bidding as required, failing to obtain a construction permit, or arbitrarily changing design drawings, or selects unqualified units to undertake relevant work, leading to quality hazards in the prefabricated panel house and its eventual collapse, the construction unit should bear primary responsibility. If the construction company fails to strictly follow the design drawings and construction specifications, such as using inferior materials, cutting corners, or operating in violation of regulations, resulting in damage to the structural safety of the prefabricated panel house and its collapse, the construction company needs to bear primary responsibility.

Responsibilities of the Design Unit

According to Article 19 of the Regulations on the Quality Management of Construction Projects, survey and design units must conduct surveys and designs in accordance with mandatory standards for engineering construction and be responsible for the quality of their surveys and designs. If the design unit designs a prefabricated panel house with an unreasonable structure, hidden safety hazards, or fails to fully consider factors such as geological conditions and climatic environment, resulting in safety issues or even collapse during the use of the prefabricated panel house, the design unit should bear corresponding responsibility.

Responsibilities of the Supervision Unit

According to Article 36 of the Regulations on the Quality Management of Construction Projects, engineering supervision units shall, in accordance with laws, regulations, relevant technical standards, design documents, and construction project contracting contracts, supervise the construction quality on behalf of the construction unit and bear supervision liability for the construction quality. If the supervision unit fails to perform its duties, such as failing to promptly detect and stop violations by the construction company, failing to strictly control the quality of materials and components, or treating the quality acceptance of the project as a mere formality, resulting in quality issues or even collapse of the prefabricated panel house, the supervision unit needs to bear corresponding responsibility.

Responsibilities of the Property Owner or User

If the collapse of a prefabricated panel house is caused by poor management by the property owner or user, such as failing to conduct timely safety maintenance on the building, the property owner or user needs to bear corresponding responsibility.
