Template for Purchase Contract of Prefabricated Houses

Quản trị 18 tháng 9, 2026

The core content of the purchase contract template for prefabricated houses (pre-sale of commercial housing) is as follows:

I. Contract Parties
The information of both the buyer and the seller must be clearly stated, including the names and contact details of Party A (the seller) and Party B (the buyer), as well as the pre-sale permit number, project name, and the location of the house to ensure the legality of the project.

II. Basic Information of the House

  1. Location and Area: The specific address of the house and the building area (including an explanation of the interior area and the shared area) should be filled in detail to avoid disputes over the area.
  2. Building Form and Purpose: The structural type (such as frame or brick-concrete) and the planned purpose (residential/commercial) should be clearly defined and consistent with the planning documents.

III. Price and Payment

  1. Total Price: The amount should be stated in Renminbi, both in figures and in words, to avoid the risk of alteration.
  2. Payment Methods:
    • One-time Payment: The payment deadline should be specified.
    • Installment Payment: Payments should be made in stages according to the progress of the project (such as the proportion of the down payment and the payment nodes for the remaining amount).
    • Loan Payment: The loan method, conditions, and the bank's approval responsibilities should be clearly defined. In case of loan failure, terms for making up the house payment or terminating the contract should be agreed upon.
  3. Fund Supervision: The pre-sale house payment must be deposited into the special account designated by the Commercial Housing Pre-sale Permit to prevent fund embezzlement.

IV. Delivery and Acceptance

  1. Delivery Time: A specific date should be agreed upon. In case of overdue delivery, liquidated damages should be paid on a daily basis (usually 0.01% - 0.05% of the total house price).
  2. Delivery Standards: The house must pass the completion acceptance and be filed, and the Residential Quality Guarantee and the Residential Use Instruction Manual should be provided.

V. Handling of Area Discrepancies
If the absolute value of the error ratio between the actually measured area and the contracted area exceeds 3%, the buyer has the right to terminate the contract or settle the house payment according to the actual area. If the error ratio is within 3%, a refund or additional payment should be made according to the contracted price.

VI. Planning Changes and Right to Terminate
If a design change affects the usability of the house (such as the addition of large steps), the buyer has the right to terminate the contract in writing; other changes require the buyer's written consent.

VII. Quality Warranty

  1. Quality Standards: The house must meet national standards and the contract terms.
  2. Warranty Period: The warranty period shall be no less than one year from the date of delivery, and the main structure shall have a lifelong warranty.

VIII. Property Right Registration
Party A shall handle the property right registration within 3 - 6 months after delivery, and Party B shall cooperate in providing the necessary materials. The liability for overdue registration shall be borne by the defaulting party.

IX. Special Tips

  1. Before signing the contract, the Commercial Housing Pre-sale Permit and planning documents should be checked.
  2. The blank spaces in the contract should be filled in through negotiation between both parties, and supplementary agreements can be signed for matters not stipulated in the contract.
  3. It is recommended to refer to the local model texts (such as the latest versions in Guangzhou and Beijing) and have them reviewed by a lawyer.
