Regulations on the Construction of Prefabricated Houses
The regulations on the construction of prefabricated houses mainly cover homestead land use rights, housing planning, area standards, approval processes, and specific requirements for prefabricated rural houses, as detailed below:

I. Homestead Land Use Rights and Planning Requirements
According to Article 362 of the Civil Code of the People's Republic of China, holders of homestead land use rights may legally use collective land to build residential houses and ancillary facilities. The construction of prefabricated houses must be based on the lawful acquisition of homestead land use rights. Meanwhile, Article 62 of the Land Administration Law specifies that housing construction must comply with the overall land use plans of townships (towns) and village plans. It is prohibited to occupy permanent basic farmland, and priority should be given to using existing homesteads or vacant land within the village to protect cultivated land resources.
II. Homestead Area Standards
Rural villagers are allowed to have only one homestead per household, with the area not exceeding the standards set by provinces, autonomous regions, or municipalities directly under the central government. For example, in some regions, villages with less than 0.8 mu of arable land per capita are limited to a maximum homestead area of 120 square meters per household. When constructing prefabricated houses, it is necessary to strictly verify the homestead area to avoid exceeding the limit and occupying land improperly.
III. Approval Process for Rural Housing Construction
- Application and Public Announcement: Villagers must submit a housing construction application to the collective economic organization or urban management department. The collective economic organization will publicly announce the application, while the land resources management office and the township social affairs office will conduct a preliminary review simultaneously.
- Review and Approval: After the public announcement period without objections, land users who meet the 'one household, one homestead' condition must be reviewed by the township people's government and then submitted to the county people's government for approval.
- Approval and Issuance of Certificates: After the homestead is approved, relevant departments will conduct on-site approval and issue a site selection opinion letter, planning permit, and construction permit. After the house is completed, on-site inspections will be conducted to issue a collective land use certificate and a house ownership certificate. Constructing a house without completing the approval process is an illegal act.
IV. Specific Requirements for Prefabricated Rural Houses (Taking Shandong Province as an Example)
- Construction Principles: They must meet the requirements of modern functionality, structural safety, cost-effectiveness, environmental friendliness, and harmonious architectural style, designed in combination with local climate, topography, and traditional architectural characteristics.
- Structural Systems: Clearly adopt structural systems such as prefabricated concrete shear walls, EPS module cast-in-place concrete, and light steel frames, and formulate detailed design and construction specifications.
- Material Specifications: Prioritize the use of green, economical, and recyclable local building materials. The use of high-energy-consuming or excessively polluting materials is prohibited.
- Design Details: The architectural style should reflect regional characteristics (such as those of central Shandong and Jiaodong regions). The floor plan should be oriented north-south to facilitate ventilation and sunlight. Functional spaces must include bedrooms, storage rooms, etc., and consider aging-friendly designs (such as barrier-free ramps).
- Construction Management: Require construction by professional teams or trained craftsmen, formulate construction organization designs and component installation plans, and clarify quality control and safety measures.
