Is Container House Illegal

Quản trị 15 tháng 9, 2026

Container houses that are not approved or not placed and modified in accordance with regulations are generally considered illegal constructions. Specific determination requires considering the following factors:

1. Container houses modified for residential or commercial use without approval are illegal constructions
If a container is modified by installing doors and windows, connecting to water and electricity supplies, adding air conditioners, etc., to make it suitable for living or business operations, and no planning permission, construction land permit, or other approval documents are obtained, its nature is the same as that of constructing a building without a permit, which is an illegal construction. For example, a restaurant in Jinshan District modified a container into a staff dormitory, and a resident in Miaozhen Town, Chongming District purchased a modified container for living; both were identified as illegal constructions and required to be rectified.

2. Containers occupying public areas or altering land use are illegal constructions
If containers are stacked in public areas such as roads, sidewalks, and farmland, or fixed by hardening the ground, building permanent foundations, etc., even if they are not modified for residential or commercial use, they may be identified as illegal constructions due to illegally occupying public space or altering land nature. For example, a container on the sidewalk in Changhai Road Subdistrict, Yangpu District was cleared due to occupying the road and posing safety hazards; a container used as a commercial billiard room in an industrial park in Haicang District was demolished due to lack of approval.

3. Containers that do not damage land nature in special scenarios may not be identified as illegal constructions
If containers are only used for temporary storage of agricultural materials and tools, without hardening the ground, connecting to water and electricity supplies, or carrying out permanent construction, and do not change land use (e.g., they are prohibited in basic farmland and ecological protection areas), some regions may not consider them illegal constructions. For example, farmers placing containers beside fields to store farm tools or placing containers on rooftops as storage rooms may be allowed to use them if they comply with local regulations and do not damage land nature.

4. Differences in local policies affect determination results
Different regions have different standards for identifying container houses. Coastal cities (such as Shanghai and Shenzhen) may introduce special policies to encourage the use of container buildings in the cultural tourism or commercial sectors, while agricultural provinces may require temporary building filings for container houses in fields. It is recommended to consult local planning and urban management departments for specific requirements before placing them.
