The prefabricated roof contract can be drafted according to the following framework, covering core clauses and clarifying the rights and responsibilities of both parties:

Clearly specify the names, addresses, legal representatives (or ID numbers), and contact information of both Party A (the entrusting party) and Party B (the entrusted party). For example:
Party A (the entrusting party): Fill in the name/company name, ID number/unified social credit code, address, and contact phone number;
Party B (the entrusted party): Fill in the company name, unified social credit code, legal representative, address, and contact phone number.
Key Point: Ensure that the subject information is true and valid to avoid disputes caused by unclear subjects.

  1. Installation Location: Clearly specify the specific address of the rooftop and the installation area for the prefabricated components (e.g., "East side of the rooftop of Building XX in XX District, XX City").
  2. Installation Content: Include the design, fabrication, transportation, installation, and technical guidance of the prefabricated components, detailing whether it includes foundation treatment, waterproof layer construction, etc.
  3. Specification Requirements:
    • Dimensional Tolerance: Must comply with national construction specifications (e.g., length, width, and height tolerances controlled within ±5 millimeters);
    • Material Standards: Use national standard materials (e.g., "C30 concrete, HRB400 steel bars") and provide quality certification documents;
    • Appearance Quality: The surface should be flat, free of cracks, and uniformly colored, complying with GB/T 50204-2015 "Code for Acceptance of Constructional Quality of Concrete Structures".
  4. Project Duration: Agree on the start date (e.g., "XX/XX/2024") and completion date, and clarify the liability for project delays (e.g., "If the delay is caused by Party B, a penalty of 0.5% of the total contract amount per day shall be paid").

III. Project Cost and Payment Method

  1. Total Cost: Clearly specify the total project cost (e.g., "RMB XX0,000, in words: XX0,000 yuan only").
  2. Payment Milestones:
    • Advance Payment: 30% of the total cost shall be paid within 3 days after the contract is signed;
    • Progress Payment: 40% shall be paid when the project progress reaches 50%;
    • Final Payment: 25% shall be paid after acceptance, with 5% reserved as a quality guarantee deposit, which shall be refunded without interest after the warranty period expires.
  3. Payment Method: Payment shall be made by bank transfer to the designated account of Party B, with the account information clearly indicated.

IV. Quality and Acceptance

  1. Quality Standards: Comply with national and local construction quality specifications (e.g., GB 50207-2012 "Code for Acceptance of Construction Quality of Roofing Works") to ensure structural safety.
  2. Acceptance Process:
    • Both parties shall jointly conduct acceptance within 5 days after completion. Upon acceptance, a "Acceptance Report" shall be signed and the project shall be handed over for use;
    • If the acceptance fails, Party B shall make rectifications to meet the standards within 10 days. A penalty of 0.5% of the total contract amount per day shall be paid for overdue rectifications.
  3. Warranty Period: Clearly specify the warranty period (e.g., 24 months). During the warranty period, Party B shall repair or replace damaged components free of charge.

V. Liability for Breach of Contract

  1. Party A's Breach: If Party A fails to make payments as agreed, a penalty of 0.1% of the unpaid amount per day shall be paid.
  2. Party B's Breach:
    • If Party B fails to complete the project on schedule, a penalty of 0.5% of the total contract amount per day shall be paid;
    • If quality issues lead to safety accidents, Party B shall bear all repair costs and compensation for Party A's losses.

VI. Dispute Resolution
It is agreed to resolve disputes through negotiation. If negotiation fails, a lawsuit may be filed with the people's court at the project location.

VII. Other Clauses

  1. The contract shall be made in duplicate, with each party holding one copy, and shall take effect upon signature (or seal) by both parties;
  2. Matters not covered herein may be covered by supplementary agreements, which shall have the same legal effect as this contract;
  3. Attachments, including project drawings, bill of quantities, acceptance standards, and other documents, shall be considered as integral parts of this contract.
