This is based on legal provisions regarding the responsibilities of management parties in public places, aiming to safeguard the personal safety of the public in public places.

Compensation Scope

In accordance with Article 1179 of the Civil Code of the People's Republic of China, the scope of compensation for personal injury caused by infringement is relatively broad. It includes reasonable expenses for treatment and rehabilitation, such as medical expenses, covering costs for examinations, treatments, and medications after injury; nursing expenses, if nursing by others is required after injury; transportation expenses, reasonable transportation costs incurred during medical treatment; nutrition expenses, costs for additional nutrition based on the injury situation; and hospital meal allowances, meal subsidies during hospitalization. In addition, if the fall results in lost work time, compensation should also be provided for the reduced income due to lost work. If the fall causes severe disability, in addition to the above expenses, compensation should also be provided for auxiliary device expenses, such as the cost of purchasing wheelchairs, crutches, and other auxiliary devices, as well as disability compensation, to compensate for long-term losses caused by the disability.

Rights Protection Approaches

After a fall accident occurs, the first step is to seek medical attention promptly and save all relevant medical expense receipts, diagnostic certificates, and other evidence materials, which are important bases for subsequent rights protection. Then, negotiate with the operator or manager to demand compensation liability. If negotiation fails, rights can be protected through mediation, arbitration, or litigation. During the litigation process, it is necessary to provide the court with sufficient evidence to prove that the operator or manager failed to fulfill safety obligations and the various losses incurred due to the fall.
