Container Rental Housing Contract
A container rental housing contract typically includes the following core clauses, which must be clearly defined based on mutual agreement and legal provisions:

I. Rental Subject
The specific specifications (such as length, width, height, area), unique identification number, geographical location, and surrounding environment (such as proximity to major transportation routes and whether heavy vehicles are allowed) of the container house must be specified. If the house is made of special materials (such as rock wool fire-resistant materials), it should be noted in the contract to avoid subsequent disputes.
II. Rental Term and Renewal
The contract should specify the start and end dates and clarify the handling method after the lease expires: If renewal is required, Party B must notify Party A in writing in advance and sign a new contract. If no written notice is given, Party A has the right to reclaim the house or adjust the rent.
III. Rent and Payment Method
- Rent Standard: The calculation method (such as monthly/annual payment) and total amount must be specified.
- Payment Method: Options for one-time payment or installment payment are available, and Party A must provide an official invoice.
- Included Fees: Some contracts stipulate that the rent includes property management fees, heating fees, etc., which should be listed in the contract to avoid hidden charges.
IV. Deposit and Refund
- Deposit Amount: Usually equivalent to 1-3 months' rent, used to ensure contract performance.
- Refund Conditions: After the lease expires and the house is returned, Party A must refund the deposit after deducting unpaid fees or penalties, provided there is no damage and no outstanding fees. If Party B terminates the contract early, the deposit may be partially or fully deducted as a penalty.
V. Usage Requirements and Prohibited Behaviors
- Structural and Functional Restrictions: Party B must not alter the structure or function of the house without Party A's written consent. Renovations require Party A's written approval.
- Prohibition of Illegal Activities: No illegal activities or storage of dangerous items (such as flammable and explosive materials) are allowed in the house.
- Fee Payment Obligations: Party B must pay rent, utilities, etc., on time, and late payments may incur late fees.
- Return Obligations: Upon lease expiration or contract termination, Party B must return the house and clean up garbage. Damages or losses must be compensated at market value.
VI. Maintenance Responsibilities
- Party A's Responsibility: Responsible for regular inspections and repairs of the house and equipment (such as leaks, electrical faults) to ensure the house meets living or usage standards.
- Party B's Responsibility: Damages caused by improper use (such as unauthorized electrical wiring, overloading) are the responsibility of Party B for repair or compensation.
VII. Liability for Breach of Contract
- Party A's Breach: If Party A fails to deliver the house on time or provide basic living conditions, the deposit must be refunded with interest.
- Party B's Breach: If rent is overdue, Party B may be required to pay three months' rent as a penalty on an annual basis; if the house is damaged, actual losses must be compensated.
VIII. Dispute Resolution
Disputes shall be resolved through negotiation first; if negotiation fails, a lawsuit may be filed with the court in Party A's location.
IX. Contract Effectiveness and Copies
The contract takes effect upon signature and seal by both parties and is usually made in multiple copies, with each party retaining one copy, all having equal legal effect.
Other clauses may include an inventory of items provided by Party A (such as beds, appliances), the party responsible for transportation costs (such as Party B bearing the costs for container delivery and return), and the requirement that the container number at return must match the contract number, etc., which should be supplemented based on actual needs. It is recommended to refer to the Contract Section of the Civil Code of the People's Republic of China and relevant judicial interpretations to ensure the legality and validity of the clauses.
