Container House National Document
Quản trị 15 tháng 9, 2026
Whether container houses are recognized as legal buildings by the state requires a comprehensive assessment based on land nature, approval procedures, and usage scenarios. Unauthorized construction without approval may constitute illegal building.

I. Core Conditions for Legality Determination
According to the "Urban and Rural Planning Law of the People's Republic of China" and local regulations, legal buildings must meet two core conditions:
- Obtain planning permission: This involves confirming land nature, going through planning filing and approval processes, and obtaining a rural construction planning permit or a construction engineering planning permit. For example, in the approval of the container house project of Yunnan Hehongsheng Prefabricated Building Co., Ltd. by the Kunming Ecological Environment Bureau, it was explicitly required to submit an environmental impact report and obtain an approval number (Kunshenghuanjinfu [2024] No. 45).
- Comply with land use: If the land is occupied for farmland, ecological protection zones, or public land, even without hardening the ground, it may be identified as illegal construction due to changes in land nature. For example, a new regulation in a certain province in 2025 requires that container houses in fields must go through temporary building filing procedures.
II. Usage Scenarios and Risk Classification
- Temporary storage purposes: If the container house is only used for storing agricultural materials, without hardening the ground or connecting to water and electricity, and does not occupy land in planned areas, it is usually not identified as illegal construction. For example, Farmer Lao Wang placed a container by the field to store farming tools and was allowed to continue using it after inspection by the urban management authorities.
- Residential or business purposes: If water and electricity are connected, foundations are poured, or the container is converted into a homestay or shop, land use approval, planning filing, and fire safety permits are required. For example, a company in Hangzhou used containers to build staff dormitories and needed to go through prefabricated building approval procedures for legal implementation.
- Placement in public areas: If roads, green spaces, or other public spaces are occupied, even without changing the land nature, relocation may be required due to infringement on public interests. For example, the Chongming Urban Management Bureau conducted a special rectification of container houses that had been transformed into buildings in its jurisdiction, emphasizing that temporary stacking requires obtaining permits or going through filing procedures.
III. Suggestions for Compliance Paths
- Approval process: After selecting a site, it is necessary to confirm the land nature, go through planning filing procedures, and apply for temporary building approval (usually with a term of 2 years, renewable). If the usage nature complies with incentive industrial policies such as creative parks and cultural tourism, priority government support can be obtained.
- Risk avoidance: Avoid placing containers on basic farmland or ecological protection zones; for business purposes, comply with the structural safety requirements of the "Technical Specification for Modular Combined Container Houses" (CECS 334:2013); for residential use, apply for a construction permit as a formal building, with a floor height not exceeding 6 floors and a total height of ≤24 meters.
