Container House Maintenance Contract

Quản trị 16 tháng 9, 2026

The container house maintenance contract should clearly specify the information of both parties, the scope of maintenance, the division of responsibilities, cost allocation, and liability for breach of contract. Details are as follows:

I. Contract Party Information

The contract should clearly state the names or designations, addresses, and contact details of the lessor (Party A) and the lessee (Party B) to ensure the legal validity of the parties' qualifications. For example, in the 'Container Contract', both Party A and Party B are required to fill in their basic information in detail for subsequent contact and liability tracing.

II. Scope and Standards of Maintenance

The scope of maintenance for the container house should be clearly defined, including but not limited to the container structure, doors and windows, electrical circuits, and waterproofing. For instance, the contract may stipulate that Party B should use the container normally and maintain it properly during the rental period. In case of malfunctions, Party B should inspect and repair it according to the technical support manual. Meanwhile, maintenance standards should be specified, such as inspection according to the SEAWORTHY standard to ensure the container meets usage requirements.

III. Division of Responsibilities and Cost Allocation

The contract should clearly define the division of maintenance responsibilities. Generally, Party B is responsible for routine maintenance and minor repairs, while Party A is responsible for major repairs or repairs due to quality issues. For example, if the container is lost, damaged, or irreparable during the rental period, Party B shall compensate according to the replacement cost, which shall be depreciated at 4% per year from the date of manufacture, but shall not be less than 60% of the replacement cost. Additionally, the contract may stipulate that Party B shall bear costs such as loading and unloading fees when picking up and returning the container.

IV. Liability for Breach of Contract and Dispute Resolution

The contract should specify liability for breach of contract, such as Party A's right to claim compensation for losses if Party B fails to repair or pay fees as agreed. Meanwhile, dispute resolution clauses can be added, such as submission to arbitration or the jurisdiction of a court if negotiation fails. For example, in the 'Container Sales Contract', both parties agree that if negotiation fails, the case shall be submitted to the People's Court at the location of Company Wu for handling.

V. Other Clauses

The contract may include clauses on deposits, rent payment methods, and refund conditions. For example, the rent is calculated on a daily basis from the date of container delivery to the date of return, and Party B is required to pay the rent to the designated account within 7 days of the container delivery date.
