How to Refund the Deposit for a Container House

Quản trị 15 tháng 9, 2026

The refund of the deposit for a container house should be resolved through negotiation, litigation, complaints, arbitration, and other means in accordance with the contract terms.

Negotiation

Firstly, amicable negotiation with the lessor is the primary step. Clearly express your intention to request a refund of the deposit and understand the reasons for the lessor's refusal to refund. If both parties can reach an agreement, sign a written agreement to clarify details such as the refund amount, method, and timing, ensuring that your rights are protected in writing.

Litigation Based on the Contract

  • Contract terms are the core basis. According to Article 470 of the Civil Code of the People's Republic of China, a contract should include clauses on liability for breach of contract. If the lease contract clearly specifies the conditions and methods for refunding the deposit, the lessor's refusal to refund constitutes a breach of contract.
  • File a lawsuit. If negotiation fails, the lessee may file a lawsuit with the court based on the contract, requesting a refund of the deposit and assuming liability for breach of contract. During litigation, evidence such as the lease contract and deposit payment receipt must be provided to prove one's rights. For example, if the contract stipulates that "after deducting the rent from the deposit upon returning the container, the remaining deposit shall be refunded unconditionally," the lessor's unjustified deduction constitutes a breach of contract.

Other Rights Protection Means

  • Complaints. File a complaint with the local housing management office or consumer protection agency regarding the lessor's behavior and seek administrative assistance.
  • Arbitration. If the contract includes an arbitration clause or both parties agree to arbitration, apply to an arbitration institution for arbitration and request a refund of the deposit.
  • Report to the police. In extreme cases, such as when the lessor's behavior constitutes fraud or infringement of property rights (e.g., forging the contract, malicious deduction), report to the public security organ and seek legal protection.

Precautions

  • Contract review. When signing a lease contract, clarify clauses on deposit refund conditions and liability for breach of contract to avoid ambiguities or loopholes. For example, the contract should stipulate that "the deposit shall be refunded in full if the container number matches the contract upon return and there is no damage."
  • Evidence retention. Retain deposit payment receipts, the original contract, communication records, etc., as evidence for rights protection.
  • Legal consultation. If you are unfamiliar with the contract terms or rights protection process, consult a professional lawyer to ensure legal and effective operations.
