Container House Contract Template
Quản trị 16 tháng 9, 2026
The container house contract template needs to be drafted based on actual transaction conditions. Currently, there is no direct ready-made template, but it can be designed by combining the following key points and similar case clauses:

I. Core Contract Clauses Framework
Contract Parties
- Clearly specify the names, ID numbers/unified social credit codes, and contact information of the lessor (property owner or authorized party) and the lessee (natural person or legal entity).
- Example: Refer to the rental announcement for the service point at Huizhou Dongjiangsha Park Stadium, where the lessor is the "Huizhou Dongjiang Park Service Center", and the lessee must be a "natural person or legal enterprise with full civil capacity".
Leased Property
- Provide a detailed description of the location, area (e.g., "12 meters long × 3 meters wide, with an area of 36 square meters"), structural type (e.g., "container structure"), and supporting facilities (such as water and electricity connections, fire safety equipment) of the container house.
- Example: In the factory rental announcement by the Xiamen Property Rights Trading Center, it clearly states the "rental area of 750 square meters", and the corresponding specifications and parameters of the container should be indicated accordingly.
Lease Term and Fees
- Lease term: Clearly specify the start and end dates (e.g., "4 years, including a rent-free period of 30 days").
- Rent and payment method: Agree on the monthly rent amount (e.g., "¥2,880 per month"), payment cycle (e.g., "three months' rent as a deposit and one month's rent in advance"), and escalation clause (e.g., "a 10% increase every three years").
- Security deposit: State the amount (e.g., "a bidding security deposit of ¥20,000") and the conditions for refund.
- Example: In the shop rental in Huicheng District, Huizhou City, the housing deposit is generally "three months' rent".
Usage and Restrictions
- Specify the intended use of the container (e.g., "shop operation") and prohibit illegal activities (e.g., "no storage of flammable and explosive materials").
- Example: The tenant's fire safety responsibility agreement clearly states that "the use of high-load appliances such as immersion heaters and electric heaters is prohibited".
Maintenance and Safety Responsibilities
- The lessor is responsible for the maintenance of the main structure of the container, while the lessee is responsible for the maintenance of the internal facilities.
- The lessee must comply with fire safety regulations (e.g., "regularly inspect electrical wiring" and "equip with fire extinguishers").
- Example: Refer to the clause in the "Tenant's Fire Safety Responsibility Agreement" stating that "the promisor bears full fire safety responsibility".
II. Risk Prevention and Control Clauses
Rent-Free Period and Liability for Breach of Contract
- Clearly specify the duration of the rent-free period (e.g., "30 days") and the conditions (e.g., "must open for business on time").
- Agree on the penalty for early termination of the contract (e.g., "20% of the rent for the remaining lease term").
Insurance and Compensation
- Require the lessee to purchase property insurance and clarify the party responsible for compensation in case of accidents such as fire and flood.
Dispute Resolution
- Agree on the jurisdiction for arbitration or litigation (e.g., "jurisdiction of the court at the place where the contract is signed").
III. Integration of Reference Case Clauses
- Rent Escalation: The clause of "a 10% increase every three years" in the shop rental in Huizhou City can be applied to long-term container leases.
- Usage Restrictions: The clause of "for shop use only" in the rental of storefronts in Xiamen resettlement housing can be refined to the type of container operation.
- Safety Responsibilities: Directly quote the clauses on the use of electrical appliances and the management of hazardous materials from the "Tenant's Fire Safety Responsibility Agreement".
Note: The actual contract should be adjusted according to the lease contract chapter of the Civil Code and local policies. It is recommended to entrust a lawyer for review or refer to the standard template of the local trading center.
