Is It Illegal to Move the Toilet Position?
Admin 02 de octubre de 2026
Whether moving the toilet position is illegal depends on the situation and cannot be generalized.

Conditions for Legally Moving the Toilet Position
If the following conditions are met, moving the toilet position is considered a regular renovation and is not illegal:
- Obtain consent from relevant parties: Written consent from neighbors and the property management company is required to avoid disputes with neighbors or obstruction from the property management due to the renovation. For example, in the renovation of old residential areas, some homeowners have triggered legal disputes by moving the toilet position without prior communication with neighbors, resulting in water leakage from the ceiling of the downstairs residents.
- Implement proper technical measures: The sewage disposal system must comply with regulations, such as using same-floor drainage technology or adding sewage lift pumps. The waterproof layer must be properly installed to prevent leakage and contamination of neighboring rooms. Sound insulation measures must be well-implemented to prevent sewage noise from affecting others. For example, when the bathroom is partially expanded or slightly relocated (≤30cm), it is usually legal if the above technical conditions are met.
- Comply with building regulations: The relocated position must meet the requirements of the "Residential Design Code", such as not being placed above the bedrooms or living rooms of downstairs residents to avoid affecting their normal lives. Additionally, structural elements like load-bearing walls must not be damaged, and the building structure must not be altered to ensure building safety.
Situations Where Moving the Toilet Position is Illegal
If the following situations exist, moving the toilet position is considered an illegal renovation:
- Lack of consent or affecting others: Moving the toilet position without the consent of neighbors and the property management company, or causing water leakage that contaminates neighboring rooms or inadequate sewage sound insulation that affects others, may result in legal liability. For example, unauthorized relocation of the bathroom that causes mold on the ceiling or wall peeling of the downstairs residents requires the responsible party to bear the costs of repair and compensation.
- Violation of renovation regulations: According to the "Administrative Measures for Interior Decoration of Residential Buildings", converting a room without waterproof requirements into a bathroom is illegal. For example, converting a kitchen or study into a bathroom is illegal even if proper technical measures are in place.
- Non-compliance with safety or planning requirements: The relocated position does not meet building safety, hygiene standards, or urban planning requirements, such as moving beyond the original land use scope without going through land use change procedures and planning permits, may result in administrative penalties.
