Use of Container Houses in Rural Areas
Admin 17 de septiembre de 2026
Whether container houses can be used in rural areas depends on the situation, and their legality mainly hinges on compliance with land management, urban-rural planning, and relevant approval requirements.

Legal Cases
- As temporary buildings with approval: If container houses are used for temporary production or living purposes, according to Article 57 of the Land Administration Law of the People's Republic of China, their construction is legal with the approval of the natural resources authorities of the people's governments at or above the county level. Such temporary use is usually related to specific projects or activities, and the structures need to be demolished or restored to their original state after the end of the use period.
- In line with homestead regulations and rural planning with approval: According to Article 62 of the Land Administration Law of the People's Republic of China, if container houses are used for living and their locations meet the homestead application conditions (such as one homestead per household and non-exceedance of the area limit), and they have been approved by the township (town) people's government after review, the construction is legal. In this case, container houses are regarded as a special form of residential housing and need to comply with homestead management regulations.
- Without changing land use or with approval obtained: When building container houses on agricultural land, if the land use is not changed (for example, still used for agricultural production-related activities) or legal approval procedures for the conversion of agricultural land have been completed, it does not violate land management regulations. However, this situation requires meeting strict approval conditions.
- Exemption conditions in some scenarios: For temporary storage on farmland or rooftops, without hardening the ground, connecting to water and electricity, and only storing agricultural materials and tools, a single 20-foot standard container is least likely to be questioned. For commercial purposes (such as homestays and shops), land use approval, planning filing, and fire safety permits are required. Priority should be given to commercial or cultural and tourism land, and cultivated land protection areas should be avoided. The structural safety should comply with the Technical Specification for Modular Combination Container Houses (CECS 334:2013). For residential use, it should be declared as a formal building, obtain a construction permit, with a height limit of no more than 6 floors and a total height of ≤ 24 meters.
Illegal Cases
- Without obtaining approval: According to Article 65 of the Urban and Rural Planning Law of the People's Republic of China, constructing container houses without approval, regardless of the location, is illegal and may have a negative impact on the overall layout and appearance of the village.
- Changing land use: According to Article 37 of the Land Administration Law of the People's Republic of China, building container houses on agricultural land and changing the land use without obtaining legal approval procedures is an illegal act.
Practical Application Precautions
- Foundation treatment: A concrete foundation is required, and in windy areas, it should be reinforced with cement.
- Insulation layer selection: The insulation layer should be made of rock wool or polyurethane.
- Subsidy application: Some places offer subsidies, with a maximum of 300 yuan per square meter. Remember to get the village committee's seal and apply before purchase.
