Rooftop Mobile Toilet
The rooftop mobile toilet is an unauthorized construction without approval, which is illegal and poses numerous risks.

Legal Aspect
According to the relevant provisions of Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, for the construction of buildings, structures, roads, pipelines, and other engineering projects within urban and town planning areas, the construction unit or individual shall apply to the urban and rural planning administrative department of the city or county government, or the town government determined by the people's government of the province, autonomous region, or municipality directly under the Central Government, for a construction project planning permit. As a building or structure, if a rooftop mobile toilet is constructed without obtaining any construction planning approval, it constitutes an illegal construction. For example, on August 20, 2026, the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District received a tip-off about suspected illegal construction on the rooftop of a residential building in its jurisdiction. Upon investigation, it was found that the resident had unauthorizedly built two aluminum alloy glass sunrooms and illegally installed a mobile toilet on the rooftop terrace. All these construction facilities had not obtained any construction planning approval and were identified as illegal constructions.
Safety Aspect
- Risk of Falling Objects from Heights: If the rooftop mobile toilet is not firmly secured, in the event of strong winds or other severe weather conditions, its components or附属 items (accessories) may fall from heights, causing serious harm to pedestrians, vehicles, etc. below.
- Risk of Structural Overloading: The design load-bearing capacity of the rooftop is limited. The weight of the mobile toilet and its internal facilities will increase the load on the rooftop. Long-term overloading may damage the rooftop structure, affect the overall safety of the building, and even trigger serious accidents such as collapse.
Public Resources Aspect
The rooftop is a public area, and all owners have shared rights to it. Unauthorized construction of a mobile toilet on the rooftop encroaches on public resources, infringes upon the legitimate rights and interests of other owners, and may lead to conflicts and disputes among neighbors.
