Rooftop Installation of Mobile Toilets

Admin 23 de septiembre de 2026

The installation of mobile toilets on rooftops is an unauthorized construction activity without planning approval, which is illegal and poses numerous risks and issues.

I. Legal Aspect

Rooftop terraces are public spaces within residential communities, and any unauthorized construction without approval is strictly prohibited. According to the relevant provisions of Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, for the construction of buildings, structures, and other engineering projects, a construction project planning permit must be obtained in accordance with the law. If relevant procedures are not followed and mobile toilets are installed on rooftop terraces without authorization, it constitutes an illegal construction activity and will face corresponding legal penalties. For example, on August 20, 2026, the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District received a tip-off about illegal activities. After investigation, it was found that a certain resident had unauthorizedly constructed two aluminum alloy glass sunrooms and illegally installed a mobile toilet on the rooftop terrace. None of the construction facilities had obtained any construction planning approval. The resident's actions were suspected of violating the above-mentioned legal provisions.

II. Public Resources Aspect

Such illegal constructions encroach upon public resources. Rooftop terraces, as public spaces within residential communities, should be jointly used and enjoyed by all property owners. However, the unauthorized installation of mobile toilets and other facilities deprives other property owners of their normal right to use this public space and disrupts the public order and fairness within the community.

III. Safety Aspect

  1. Increased Load on the Rooftop: Mobile toilets have a certain weight, and the sewage generated during use further adds to the load on the rooftop. Being under such an excessive load for a long time may cause damage to the rooftop structure and affect the structural safety of the entire building.
  2. Risk of Falling Objects from Heights: Mobile toilets installed on rooftops may have their fixing devices loosen in the event of strong winds or other severe weather conditions, posing a risk of falling from the rooftop and causing serious threats to pedestrians and vehicles below.
  3. Roof Leakage Issues: The installation of mobile toilets may damage the original waterproof layer on the rooftop, leading to roof leakage. Once roof leakage occurs, it will not only affect the normal life of residents on the top floor but may also cause damage to the electrical wiring within the building, triggering more serious safety accidents.
