Penalties for Moving Toilets

Admin 21 de septiembre de 2026

Penalties for unauthorized movement of toilets are determined based on specific regulations and circumstances, typically including orders for correction, fines, and compensation measures.

I. National Regulatory Basis

According to Article 36 of the "Regulations on Urban Appearance and Environmental Sanitation," unauthorized removal or relocation of environmental sanitation facilities (including mobile toilets) without approval, or failure to dismantle them in accordance with the approved plan, shall result in an order from the urban people's government's administrative department for urban appearance and environmental sanitation to cease the illegal act, clean up, dismantle, or take remedial measures within a specified time limit, and may also be subject to a fine. This clause clarifies the illegal nature of unauthorized toilet relocation and the administrative authority's disposal rights, but does not specify the amount of the fine, which requires further refinement in conjunction with local regulations.

II. Supplementary Provisions in Local Regulations

Taking the "Jiangsu Provincial Regulations on Urban Appearance and Environmental Sanitation" as an example, unauthorized relocation of environmental sanitation facilities shall result in an order from the urban appearance and environmental sanitation management department to make corrections within a specified time limit; if corrections are refused, a fine ranging from 500 to 3,000 yuan may be imposed; if the facilities are damaged or rendered non-functional, compensation shall also be made in accordance with the law. This clause further quantifies the penalty standards:

  1. Order for Correction within a Specified Time Limit: Requires the violator to restore the facilities to their original state or take remedial measures;
  2. Fine Gradient: Sets a fine range of 500 to 3,000 yuan for those who refuse to make corrections, with the specific amount determined by the enforcement department based on the severity of the circumstances;
  3. Compensation Obligation: If the relocation results in damage to the facilities or loss of functionality, civil compensation shall be borne.

III. Core Elements of Penalty Discretion

Specific penalties shall be determined based on a comprehensive assessment of the nature, circumstances, and consequences of the illegal act, including but not limited to:

  • Subjective Malice: Whether there was intentional destruction or evasion of the approval process;
  • Objective Impact: Whether the relocation of the toilet has resulted in damage to public environmental sanitation or inconvenience for residents;
  • Extent of Damage: Whether the facilities are repairable or have completely lost functionality.
    For example, if the toilet is only temporarily relocated without causing damage, an order for correction may suffice; if it is maliciously demolished resulting in the scrapping of the facilities, the maximum fine and full compensation may be imposed.

IV. Considerations in Law Enforcement Practice

When imposing penalties, administrative organs shall adhere to the principle of procedural legality, including filing and investigation, evidence collection, notification of rights, and hearing statements and defenses, to ensure that penalty decisions comply with the requirements of the "Administrative Penalty Law."
