Mobile Toilet Sales Contract

Admin 28 de septiembre de 2026

A mobile toilet sales contract typically includes key sections such as contract parties, product details, pricing and payment terms, delivery and installation, after-sales service, acceptance criteria and methods, liability for breach of contract, dispute resolution, and other clauses.

The contract parties section should clearly specify the names, addresses, and contact information of Party A (the purchaser/buyer) and Party B (the supplier/seller) to ensure both parties' identities are clear and facilitate subsequent communication and liability tracing.

Product details cover specific requirements such as product name, model and specifications, quantity, quality standards, materials, dimensions, and performance. Quality standards must comply with current national and industry standards, and a quality inspection certificate should be provided. Material and performance indicators, such as wall material, frame material, dimensions, waterproofing, fire resistance, and ventilation, should also be clearly defined.

In terms of pricing and payment terms, the unit price and total contract amount should be clearly stated, along with whether all costs, including equipment fees, transportation fees, installation and commissioning fees, and taxes, are included. The payment method should specify the proportion of advance payment, payment after acceptance, warranty deposit, and payment timing.

The delivery and installation clauses include the delivery time, generally within a certain number of working days from the contract signing date; the delivery location; the transportation method and risk assumption, with Party B responsible for damage or loss during transportation; and the installation and commissioning time and requirements, with joint acceptance by both parties upon completion.

After-sales service includes a warranty period, during which Party B is responsible for free repair or replacement in case of faults or damage due to product quality issues within a certain period from the acceptance date. Outside the warranty period, Party B provides lifelong paid maintenance services, charging reasonable costs.

Acceptance criteria and methods involve verifying product quality and standards as agreed in the contract. Party A should conduct acceptance within a certain number of working days after receiving the goods and has the right to request returns or exchanges if quality issues or non-compliance with the contract are found.

Regarding liability for breach of contract, if Party B fails to deliver within the agreed time or the goods have quality issues, it should bear corresponding responsibilities. If Party A fails to pay the contract amount on time, it should pay a penalty for late payment.

Dispute resolution stipulates that the interpretation, performance, and dispute resolution of this contract are governed by the laws of the People's Republic of China. Any disputes arising during contract performance should first be resolved through friendly consultation. If consultation fails, either party has the right to file a lawsuit with the people's court at the contract signing location.

Other clauses include that the contract takes effect upon the signatures (seals) of both parties and is made in duplicate, with each party holding one copy. For matters not covered herein, both parties may negotiate separately and sign a supplementary agreement, which has the same legal effect as this contract.
