Mobile Toilet Approval
Admin 20 de septiembre de 2026
Whether a mobile toilet requires approval depends on factors such as the usage scenario, land nature, and setup duration, and specific situations need to be discussed separately:

I. Regular Approval Process
If the construction of a mobile toilet involves changes in land use or long-term fixed use, the following approvals are required:
- Planning and Site Selection Approval: It must comply with the overall land use plan and urban-rural planning. The planning department conducts a preliminary review and on-site inspection and issues a planning site selection opinion.
- Land Use Approval: After obtaining the planning site selection opinion, submit a land use application to the land and resources department. After passing the review, the county-level people's government approves the land use.
- Construction Project Approval: This includes design plan review, construction drawing review, and construction permit application. It is necessary to ensure compliance with building safety, hygiene, environmental protection, and other standards.
II. Approval Differences in Different Scenarios
- Temporary Use (e.g., exhibitions, concerts):
- Usually, it is only necessary to report to the event organizer or venue manager, and no complex approval is required.
- If it occupies public places and the setup duration does not exceed 3 months, approval from the urban management or sanitation department may not be required; however, if it exceeds 3 months, materials such as a location diagram and equipment specifications need to be submitted for a permit application.
- Change in Land Use (e.g., using industrial or agricultural land for the construction of a mobile toilet):
- It is necessary to first submit an application for land use change to the natural resources department and obtain approval before construction can proceed.
- Erection in Public Areas (e.g., urban roads, parks, squares):
- Approval from the urban planning department, urban management department, etc., must be obtained, and it must comply with urban planning and management requirements; unauthorized erection without approval will face penalties such as an order to dismantle and a fine.
- Commercial Operation Purposes (e.g., charging for toilet services):
- In addition to land use change approval, it is also necessary to handle relevant commercial operation permits such as a business license and hygiene permit.
III. Compliance Requirements in Special Scenarios
- Placing a Mobile Toilet on Rural Homestead Land:
- It must meet conditions such as being within the scope of legal homestead land, not violating rural construction planning and building codes, having fecal waste treatment that complies with environmental protection regulations, and not affecting the neighboring rights and interests of neighbors.
- Container Mobile Toilets:
- Although they are temporary facilities, if they occupy public places or involve business relationships, they still need to be declared and approved in accordance with the law.
IV. Legal Basis
Mobile toilet approval must comply with relevant laws and regulations such as the Urban and Rural Planning Law of the People's Republic of China, the Land Administration Law of the People's Republic of China, and the Urban Real Estate Administration Law of the People's Republic of China to ensure legal and compliant construction.
