Maintenance Fund for Container Houses

Admin 16 de septiembre de 2026

Whether container houses need to pay maintenance funds requires discussion on a case-by-case basis. The maintenance fund policies for conventional commercial housing do not directly apply to container houses, but similar fees may be involved in specific scenarios.

I. Maintenance Fund Policies for Conventional Commercial Housing (Not Directly Applicable to Container Houses)

According to publicly available information, the maintenance fund for conventional commercial housing is divided into two parts:

  1. Payment Standards

    • Payment by Proportion: Homebuyers are required to pay 2%-3% of the purchase price or calculate based on the building area (90 yuan per square meter for high-rise buildings and 50 yuan per square meter for multi-story buildings).
    • Payment by Construction Cost: Some cities (such as Wuhan) stipulate that buildings equipped with elevators should deposit 8% of the construction and installation cost per square meter, while those without elevators should deposit 5%.
  2. Scope of Use
The maintenance fund is exclusively used for the repair, renewal, and renovation of common parts, public facilities, and equipment of the property, such as elevators, roofs, and exterior walls, and shall not be diverted for other purposes.

  3. Payment Time and Method

    • Payment Time: Homeowners are required to pay the maintenance fund before the house is delivered.
    • Payment Method: It can be directly deposited into a special account or entrusted to a real estate development enterprise for payment (the enterprise is required to deposit the funds into the special account within 30 days).

II. Particularities of Container Houses

  1. Property Rights Nature
If container houses are used as temporary buildings or houses without property rights (such as container houses on construction sites), they usually do not involve the payment of maintenance funds because they do not fall within the scope of legal property.

  2. Fees in Special Scenarios

    • Judicial Auction Scenario: If a container house is sold through a judicial auction (such as the case of the Juzili Night Economy Cultural Activity Block in Sihui City), the buyer is required to bear the miscellaneous fees incurred during the transfer, including the housing maintenance fund (if any). However, whether such fees actually exist depends on the property rights nature of the house and local policies.
    • Commercial Project Renovation: If container houses are used as commercial projects (such as night market stalls) and the overall project involves the repair of common parts of the property, the operator may uniformly collect similar fees, but their nature is different from that of conventional maintenance funds.

III. Suggestions

  1. Verify Property Rights Nature: If a container house has independent property rights, it is necessary to consult the local housing and construction department or property management company to confirm whether a maintenance fund needs to be paid.
  2. Review Contract Terms: When purchasing or leasing a container house, it is necessary to clarify whether the contract includes terms related to the maintenance fund to avoid subsequent disputes.
  3. Pay Attention to Local Policies: Different cities may have different policies on maintenance funds for non-conventional houses, so local regulations shall prevail.
