Is Residential Container a House

Admin 17 de septiembre de 2026

Whether a residential container can be considered a house cannot be generalized and needs to be judged comprehensively based on its modification status, degree of fixation, actual use, and approval procedures. Those that are modified without approval and meet the characteristics of illegal construction are considered illegal buildings. From the perspective of form and function, it is a habitable building form, but legal recognition focuses on building planning regulations.

From the perspective of form and function, a residential container is a habitable building form created by modifying a basic container structure module. It has certain living functions and can be regarded as a special type of habitable building at this level.

However, from a legal perspective, whether a residential container can be considered a house focuses more on whether it complies with relevant building planning regulations. If it is modified into a house-like form without approval, such as by connecting to water and electricity supplies, opening doors and windows, or installing air conditioners to make it habitable, then it is considered an illegal building. When determining whether a container is an illegal building (the identification of a building's nature is often related to illegal construction), the following factors are mainly considered:

  • Degree of fixation: If a residential container is permanently fixed in a certain location, for example, by laying a concrete foundation or installing doors and windows, which changes its original movable nature and increases its stability, it is more likely to be identified as an illegal building in such cases.
  • Actual use: When a residential container changes its original use, for example, being converted into dormitories, offices, or other places for long-term residence or office work, and does not have the corresponding construction project planning permit, it will also be identified as an illegal building.
  • Approval procedures: Whether a construction project planning permit has been obtained is a key factor. If a residential container is modified and used for residence or other purposes without the approval of the relevant department, even if it has the form and function of a house, it cannot be legally recognized as a legitimate house but rather as an illegal building.
