Illegal Modification into Mobile Toilet

Admin 13 de octubre de 2026

Whether the illegal modification into a mobile toilet is unlawful depends on the specific circumstances.

I. Unauthorized Installation in Rental Properties
If a mobile toilet is installed in a rental property without the consent of the lessor, it violates Article 715 of the Civil Code of the People's Republic of China. This article stipulates that if a lessee improves or adds other objects to the leased property without the consent of the lessor, the lessor may request restoration to the original state or compensation for losses. For example, if a tenant installs a mobile toilet in a room without informing the landlord, they may be required to remove it and restore the room to its original state due to potential damage to the original functional layout of the house or sanitation hazards.

II. Alteration of Building Structure or Addition of Facilities
If the alteration involves changing the building structure or adding facilities, such as converting a room without waterproofing requirements into a bathroom, it violates Article 5 of the Measures for the Administration of Interior Decoration and Renovation of Residential Buildings (Revised in 2011). This article explicitly prohibits altering the main structure and load-bearing structure of a building, or enlarging the original dimensions of doors and windows on load-bearing walls, or removing brick or concrete walls connecting balconies without a design plan proposed by the original design unit or a design unit with the corresponding qualification level. For example, converting a bedroom into a bathroom requires a new waterproof layer. If legal approval is not obtained, it may constitute illegal renovation.

III. Unauthorized Installation in Public Spaces
Installing a mobile toilet in public spaces such as rooftops without approval is considered an illegal construction act. According to Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, for the construction of buildings, structures, and other engineering projects within urban and town planning areas, an application for a construction project planning permit must be submitted to the competent department of urban and rural planning. For example, if a resident of a residential community installs a mobile toilet on the rooftop terrace without going through the relevant procedures, they are suspected of violating this article, and the law enforcement department may request rectification within a time limit or enforce demolition.

IV. Other Unlawful Situations
If the installation of a mobile toilet violates land use regulations (such as setting up a mobile toilet for non-agricultural purposes on agricultural land) or affects public interests (such as blocking sunlight, affecting ventilation, producing odors, or posing fire safety hazards), it may also be identified as illegal construction. For example, setting up a mobile toilet beside farmland for commercial operations may be punished for altering land use.

Recommendation: Before installing a mobile toilet, it is necessary to consult with the lessor and obtain consent to ensure compliance with building safety standards and relevant laws and regulations. If it involves altering the building structure or adding facilities, it is advisable to consult professionals or relevant departments to obtain approval and guidance.
