Emptying Container Houses

Admin 14 de septiembre de 2026

Emptying container houses must be carried out in accordance with their intended use, property rights, and legal regulations, typically involving negotiation, legal proceedings, or enforcement measures.

Negotiated Evacuation

If the container house is rented, upon the expiration of the lease or termination of the contract, the lessor has the right to request the lessee to vacate the premises. Both parties can negotiate to determine the evacuation time, method, and handling of items. For example, in commercial leases, tenants should move out and restore the premises to their original condition as agreed upon after the lease expires.

Legal Proceedings

  • Litigation Approach: If negotiation fails, the property owner may file a lawsuit with the court to request the tenant or illegal occupant to vacate the premises. The court will make a judgment based on the facts and legal provisions, requiring the defendant to move out within a specified period. For instance, in a case executed by the Maonan Court, due to the tenant's refusal to relocate from a dangerous building, the court made a legal judgment and forcibly evacuated the premises.
  • Application for Enforcement: After obtaining a court judgment, if the defendant still fails to fulfill the obligation to vacate the premises, the property owner may apply to the court for enforcement. The court will organize enforcement personnel to legally evacuate the premises, ensuring the legitimate rights and interests of the property owner.

Precautions for Enforcement

  • Safety First: During the enforcement process, the safety of enforcement personnel, parties involved, and surrounding individuals should be ensured. For potentially dangerous situations, such as unstable building structures or flammable and explosive materials, a safety plan should be prepared in advance.
  • Item Handling: During the evacuation process, items inside the premises should be properly handled. For valuable and movable items, the parties involved should be notified to move them out themselves or have them stored at a location designated by the court; for valueless or immovable items, they may be cleared or disposed of in accordance with the law.
  • Witnessing and Recording: The enforcement process should invite third parties, such as representatives of the people's congress, members of the political consultative conference, or community staff, to witness it, ensuring transparency. At the same time, detailed records of the enforcement process should be kept, including the time, location, enforcement personnel, parties involved, and item handling, for future reference.
