Container Renovation for Underground Houses
Admin 16 de septiembre de 2026
Whether it is legal to use containers as basements on homesteads requires judgment based on different situations. Legality depends on the purpose, approval procedures, and compliance with safety and planning requirements.

Legal Situations
- Temporary and Auxiliary Use: If the container is only used as a temporary and auxiliary storage space, such as for storing farm tools and miscellaneous items, and does not cause substantial changes to the original structure and purpose of the homestead. At the same time, it needs to comply with local regulations on temporary buildings, such as the usage period and construction standards of temporary buildings. In addition, it is necessary to ensure that the placement of the container does not affect the overall planning and safety of the homestead and does not violate other relevant laws and regulations, such as not occupying fire exits and not affecting the lighting of adjacent buildings. In such cases, it may be considered legal.
- Legal Approval and Renovation: If the container has undergone legal approval procedures and has been renovated into a building space that meets the usage standards for basements. For example, it is renovated according to the requirements for waterproofing, fire prevention, and ventilation of basements and passes the inspection by relevant departments. Moreover, the renovated container basement, together with the original buildings on the homestead, forms a complete residential system. Under the premise of complying with relevant planning and safety standards, it may be legal.
Illegal Situations
- Unauthorized Change of Purpose without Approval: The use of homesteads needs to follow strict planning and approval procedures. If, without approval, a container is used as a basement, changing the original purpose and planning of the homestead, it may violate relevant laws and regulations such as the "Urban and Rural Planning Law of the People's Republic of China". Once discovered, it may face legal consequences such as being ordered to be demolished and fined.
- Impact on Safety and Planning: If the placement or renovation of the container poses safety hazards, such as structural instability, which may lead to collapse due to soil pressure and groundwater erosion in the underground environment; affecting fire exits and obstructing rescue and personnel evacuation in case of a fire. Or if it disrupts the overall planning of the area where the homestead is located, for example, being out of harmony with the style and layout of surrounding buildings and affecting the overall appearance of the village, it may also be considered illegal.
