Value-Added Tax on Container Houses

Admin 16 de septiembre de 2026

The value-added tax (VAT) situation for leasing container houses varies depending on the taxpayer's qualification and specific business operations. General taxpayers are subject to a 9% tax rate, while small-scale taxpayers are subject to a 5% collection rate, with specific preferential policies available.

I. VAT Regulations for General Taxpayers

  1. Tax Rate Standards
According to the Interim Regulations of the People's Republic of China on Value-Added Tax, leasing houses (including container houses) by general taxpayers falls under the category of 'real estate business leasing services,' with an applicable tax rate of 9%.

    • If rent is collected in a lump sum, it can be evenly apportioned over the lease term. If the apportioned monthly rent does not exceed 150,000 yuan, VAT is exempt.
    • Special Circumstances: For real estate acquired before April 30, 2016, general taxpayers may choose the simplified tax calculation method, calculating tax payable at a 5% collection rate.
  2. Policy Basis

    • The Interim Regulations of the People's Republic of China on Value-Added Tax clarify the tax rate classification for real estate leasing services.
    • The apportionment rules for lump-sum rent collection and the conditions for VAT exemption are based on the relevant implementation guidelines from the State Taxation Administration.

II. VAT Regulations for Small-Scale Taxpayers

  1. Collection Rate and Exemption Policies

    • Small-scale taxpayers leasing houses are subject to a VAT collection rate of 5%, applicable to both individuals and enterprises.
    • Exemption Conditions:
      • From April 1, 2022, to December 31, 2022, small-scale taxpayers issuing regular VAT invoices are eligible for exemption (the tax rate column on the invoice should select 'exempt' rather than '0%').
      • If the monthly rent does not exceed 150,000 yuan (450,000 yuan quarterly), VAT is exempt (this policy can be叠加 with the temporary exemption policy mentioned above, subject to the latest policies).
    • Special Invoice Restrictions: If a VAT special invoice is issued, exemption is not applicable, and the tax rate is 3%.
    • Inapplicable Circumstances: If the collection rate for real estate leasing business is 5%, other VAT exemption policies for small-scale taxpayers do not apply.
  2. Continuous Invoicing Limit
If a small-scale taxpayer's invoicing amount exceeds 5 million yuan over 12 consecutive months, they will be compulsorily upgraded to a general taxpayer and will no longer be eligible for VAT preferential policies for small-scale taxpayers.

III. Other Considerations

  1. Income Tax Payment
VAT preferential policies do not affect the normal payment of income tax. If eligible as a small low-profit enterprise, the income tax rate is 5% for taxable income between 1 million and 3 million yuan, and 2.5% for taxable income not exceeding 1 million yuan.

  2. Dynamic Policy Adjustments
VAT policies may be adjusted according to notifications from the State Taxation Administration (e.g., extensions or terminations of temporary exemption policies), subject to the latest documents.
