Container House Rental Contract

Admin 17 de septiembre de 2026

A container house rental contract typically includes the following key elements:

I. Basic Information of the Leased Property The contract must specify that the leased property is a container house, providing a detailed description of its specific location, floor area, and the basic infrastructure provided (such as water and electricity facilities, doors, and windows). The lessor (Party A) shall ensure that the container meets cargo-worthiness standards and clearly state the container number and initial condition upon delivery to ensure that the lessee (Party B) can use it normally.

II. Rental Term The contract must specify the start and end dates of the rental period and outline the lessee's obligations upon expiration, including returning the leased property and restoring it to its original condition. If the lessee wishes to renew the lease, they must negotiate with the lessor in advance and sign a supplementary agreement to avoid disputes arising from ambiguous terms.

III. Rent and Payment Method The rent clause should include the total amount, annual rent, and monthly rent, along with clear payment deadlines (e.g., payment of the initial rent before the start of the lease, followed by payments every three months). The liability for late rent payment should be emphasized, such as paying a penalty of 0.5% of the overdue rent per day, with the lessor having the right to terminate the contract and reclaim the leased property if the rent is overdue for more than 30 days.

IV. Use and Maintenance of the Leased Property The lessee shall use the leased property reasonably and shall not alter its purpose or structure without authorization, otherwise, they shall pay a penalty and compensate for any losses. The lessee is responsible for regular maintenance and upkeep of the leased property and shall bear the repair costs for any damage caused by improper maintenance. The lessor has the right to inspect the use of the leased property periodically and may require the lessee to make immediate corrections for any violations and pursue legal liability if necessary.

V. Delivery and Return Terms The lessor must ensure that the delivered container is intact and that its number matches the contract. The lessee shall return the container in its original condition and complete the return procedures with the original contract and deposit receipt. If there are quality issues upon return, the lessee shall bear the repair costs (after providing written notice to the lessor in advance and submitting an estimate), otherwise, the lessor has the right to deduct the corresponding costs from the deposit.

VI. Liability for Breach of Contract In addition to the liabilities for late rent payment and unauthorized alteration of purpose mentioned above, the contract shall also specify the handling of situations where the lessee defaults on rent, subleases, sells, or mortgages the container without authorization. In such cases, the lessor has the right to terminate the contract, reclaim the leased property, and demand full compensation for losses from the lessee.

VII. Other Terms The lessee shall bear the costs of transportation, lifting, and site leveling for the container and is strictly prohibited from using non-specialized equipment such as excavators for lifting, otherwise, damages shall be handled at the purchase price, and the lessor shall not accept the return of the container. The dispute resolution method may be agreed upon as filing a lawsuit with the maritime court if negotiation fails, ensuring professional and efficient handling of disputes. The contract content must comply with the provisions of the Civil Code of the People's Republic of China and relevant laws and regulations.
