Placement of Container Houses

Admin 15 de septiembre de 2026

The legal placement of rural container houses requires meeting the following conditions:

1. Legality of Homestead Use
Container houses must be placed on confirmed homesteads. If the homestead itself is an illegal construction or if it occupies someone else's homestead without permission, the placement is illegal. For example, unauthorized construction without obtaining homestead use rights may face the risk of demolition.

2. Approval Required for Wasteland Use
If placed on unused land such as barren mountains, slopes, abandoned ponds, or ditches, it is necessary to consult with the land management department in advance and obtain government approval. Unauthorized occupation of such land without approval may be identified as illegal construction due to changes in land nature or use.

3. Avoid Affecting Public Interests
Container houses must not obstruct rural traffic or affect the lives of other villagers. For example, they must not occupy public roads, fire lanes, or neighborhood passage spaces; otherwise, they may be required to rectify or be demolished for violating the Urban and Rural Planning Law.

4. Compliance with Land Nature Requirements

  • Cultivated Land and Basic Farmland: Construction of container houses is strictly prohibited, even for temporary use.
  • Forest Land: Approval from the forestry department is required, and relevant procedures must be completed before placement.
  • Leased Land: It is usually only allowed for temporary construction use. The purpose must be clearly stated in the contract, and it must not be擅自 changed (changed without permission) to a permanent residence.

5. Approval Required for Long-Term Residence
If planning to use a container house as a permanent residence, it is necessary to follow local requirements to complete the house construction approval process and provide structural drawings stamped by an engineer. Direct construction without fulfilling the approval process may be identified as illegal construction.

6. Structural Safety and Maintenance
Container houses are steel-structure buildings and require regular rust prevention, waterproof sealing, and internal condensation dew treatment. For example, cutting and welding areas need to be polished and coated with epoxy primer and topcoat. Door and window joints need to have their sealant replaced regularly to avoid safety hazards caused by rust or leakage.

7. Compliance in Special Scenarios

  • Placement in Fields or on Roofs: If the ground is not hardened, water and electricity are not connected, and it is only used for agricultural material storage, it may not be identified as illegal construction; however, if a cement foundation is poured, water and electricity are connected, or it is changed to a commercial use (such as a homestay), relevant approval procedures must be completed.
  • Commercial Use: For example, container house homestays require an operating permit and government approval, and they must be temporary buildings that do not exceed the approved period. Appropriate compensation may be obtained in case of demolition.
