New Policy on Container Houses
Admin 16 de septiembre de 2026
Whether container houses are considered illegal constructions depends on specific conditions. Those that do not alter land properties and meet temporary use standards are generally not considered illegal, but those that exceed restrictions or fail to go through approval procedures may be identified as illegal constructions.

I. Legal Definitions and Core Criteria for Determination
According to current regulations, the core characteristics of illegal constructions include: failure to obtain planning permits, occupation of land outside planned areas, unauthorized alteration of land properties or building functions. The uniqueness of container houses lies in their essence as "movable metal structures". If they meet the following conditions, they are usually not considered illegal constructions:
- Detachable, without foundations, and non-land-occupying: Container houses with unhardened ground, no access to water and electricity, and used solely for agricultural material storage are generally not considered illegal constructions as they do not alter land properties or result in permanent occupation. For example, in 2024, the natural resources bureau in a certain location clarified that container houses of this type do not need to be demolished.
- Exceeding restrictions leads to illegal construction: If concrete foundations are poured, water and electricity are connected for long-term residence, or they are converted to commercial uses (such as homestays or shops), they may be identified as "substantially altering land use" and face the risk of demolition.
II. Regional Policy Differences and Enforcement Standards
- Inclusive policies: Coastal cities such as Shanghai and Shenzhen have introduced special policies to encourage the use of container houses in cultural tourism and commercial sectors, with relatively lenient regulations.
- Strict control policies: Some major agricultural provinces require temporary building registration for container houses in fields, even if they are only used for storing agricultural tools. For example, new regulations in a certain province in 2025 specify that approval procedures must be followed for such uses.
III. Compliant Use Scenarios and Conditions
- Temporary storage on farmland/roofs: Conditions include unhardened ground, no access to water and electricity, and storage of only agricultural materials and tools. A single 20-foot standard container (6 meters long) is least likely to be questioned.
- Commercial uses: Require land use approval, planning registration, and fire safety permits. Priority should be given to commercial/cultural tourism land, avoiding cultivated land protection zones, and compliance with the structural safety requirements of the "Technical Regulations for Modular Combination Container Houses" is necessary.
- Residential uses: Require formal building construction permit applications, with a maximum of 6 floors and a total height of ≤24 meters. For example, a company in Hangzhou legally used container houses to build staff dormitories through prefabricated building approval.
