Container House Lease Contract

Admin 16 de septiembre de 2026

The container house lease contract is a written agreement that clarifies the rights and obligations of the lessor and the lessee. Its core clauses cover the leased subject, term, rent payment, rights and obligations of both parties, and dispute resolution methods. The specific content is as follows:

I. Leased Subject
The contract must specify the exact location, area, room number, and supporting facilities of the container house. Party A shall provide it and ensure it meets habitable conditions. For example, Party A should conduct a comprehensive inspection and repair before Party B moves in to ensure the house is safe and usable. If the leased container must comply with fire protection and safety supervision regulations (such as using rock wool flame-retardant materials), Party A shall bear the consequences of non-compliant materials.

II. Lease Term
The lease term must specify the start and end dates, usually measured in years. If Party B wishes to renew the lease, it shall submit a written application 30 days before expiration and obtain Party A's consent. For example, the contract may stipulate, 'Upon expiration of the lease term, Party B shall have the right of first refusal to renew the lease, provided that it gives Party A 30 days' prior written notice.'

III. Rent and Payment Method

  1. Rent Standard: It can be a fixed monthly rent (e.g., XXX yuan per month) or calculated on a daily basis (e.g., XXX yuan per day for 360 days, with additional terms for exceeding this period).
  2. Payment Method: Usually, payment is made annually, and Party B must complete the payment via bank transfer or other means before the end of each year. Alternatively, a deposit deduction model can be adopted, where Party A collects a deposit and deducts the rent from it when the container is returned.
  3. Special Clauses: For example, Party B shall bear the costs of container transportation and lifting, or compensate at the purchase price for damage caused by违规操作 (non-compliant operations, such as using a excavator for lifting that damages the container).

IV. Rights and Obligations of Both Parties

  1. Obligations of Party A:
    • Regularly inspect the house for safety, notify Party B in advance for repairs, and arrange temporary accommodation if necessary.
    • Provide necessary assistance (such as resolving usage issues and offering life advice).
  2. Obligations of Party B:
    • Take good care of the house facilities, not alter the structure or purpose without consent; restore the original condition upon lease termination and compensate for any damage.
    • Comply with laws, regulations, and Party A's rules and regulations; not disturb others or engage in illegal activities.
    • Bear the maintenance costs of internal facilities (such as electrical circuits and door locks) on its own; ensure the container number matches the contract upon return.

V. Dispute Resolution and Contract Effectiveness
The contract shall take effect upon the signatures and seals of both parties and be made in multiple copies (usually one for Party A and two for Party B). Disputes shall be resolved through consultation first, and if consultation fails, a lawsuit can be filed with the local court.

Notes: Contract clauses should be adjusted according to actual circumstances. It is advisable to consult legal professionals to ensure legality and avoid disputes arising from missing or ambiguous clauses.
