Container House Land Use Policy
Admin 16 de septiembre de 2026
The land use policy for container houses requires a comprehensive assessment based on the specific purpose, land nature, and the region in which they are located. Generally, approval procedures are necessary, although some temporary and non-hardened uses may be exempted.

I. Requirements Related to Land Management
According to the Land Administration Law of the People's Republic of China, the use of land for container houses must meet the following conditions:
- Approval for Conversion of Agricultural Land: If agricultural land (such as cultivated land or forest land) is occupied for the construction of container houses, approval for the conversion of agricultural land must be obtained. Otherwise, it constitutes illegal land use.
- Compliance with Land Use Planning: The construction of township enterprises, rural public facilities, etc., must comply with the overall land use plan and annual plan of the township. If container houses fall under such uses, they must pass planning reviews.
II. Requirements Related to Urban and Rural Planning Management
Based on the Urban and Rural Planning Law of the People's Republic of China, container houses must meet the following planning requirements:
- Construction Project Planning Permit: For the construction of container houses within urban or town planning areas, an application for a construction project planning permit must be submitted. Failure to do so may result in the construction being deemed illegal.
- Land Use Control: The land used for container houses must comply with the purposes determined by urban and rural planning. Unauthorized changes in land nature (such as converting agricultural land into construction land) are prohibited.
III. Special Scenarios and Temporary Land Use Policies
- Temporary Activities or Public Spaces: If container houses are used for temporary activities (such as exhibitions or temporary construction housing) or are located on both sides of streets or in public spaces, approval from urban management departments must be obtained, and approval procedures must be completed.
- Principles of Temporary Land Use: Temporary land use (such as for supporting housing for projects with a construction period not exceeding two years) must comply with planning, and temporary land use procedures must be completed. After the expiration of the temporary use period, the land must be restored to its original state.
IV. Detailed Conditions for Compliant Use
- Temporary Storage on Farmland/Roofs: If container houses are used solely for storing agricultural supplies and tools and meet the conditions of "no hardening of the ground, no access to water and electricity, and a single 20-foot standard container," approval may be exempted.
- Commercial Uses (Homestays, Shops): Approval for land use, planning filing, and fire safety permits are required. Priority should be given to commercial or cultural and tourism land. Avoid cultivated land protection zones. Structural safety must comply with the Technical Specification for Modular Combined Container Houses (CECS 334:2013).
- Residential Use: A formal construction permit must be applied for. The height limit is no more than six stories, with a total height of ≤24 meters. Failure to comply may result in demolition risks.
V. Policy Differences and Trends
- Regional Differences: Coastal cities (such as Shanghai and Shenzhen) have a higher tolerance for container houses and have introduced special policies to encourage their use in the cultural tourism and commercial sectors. Some agricultural provinces (such as a certain province's 2025 new regulations) require temporary building filings for container houses in farmland.
- Trend Towards Standardization: Container architecture is moving from a "gray area" to compliance, with policies gradually clarifying approval procedures and technical standards.
