Container House in Community
Whether it is feasible to build container houses within the red line of a residential community needs to be discussed on a case-by-case basis. Generally, temporary, movable container facilities that comply with relevant regulations can be exempted from construction project planning permits, but multiple prerequisites must be met.

Applicable Conditions for Exemption
According to the response from the Shenzhen Planning and Natural Resources Bureau, the use of movable, temporary container facilities, etc., within the management scope of a residential community for holding temporary community activities can generally be exempted from applying for construction project planning permits. However, the following prerequisites must be met simultaneously:
- Compliance with Laws and Regulations: It is necessary to comply with the property-related provisions of the Civil Code of the People's Republic of China and relevant laws and regulations. For example, it is not allowed to擅自 change (unauthorized alteration of) land use or infringe upon the rights and interests of others.
- No Harm to the Rights and Interests of Interested Parties: It is necessary to ensure that the construction and use of container houses do not affect the legitimate rights and interests of adjacent property owners, such as sunlight, ventilation, and passage, so as to avoid disputes.
Exemption Does Not Mean Exemption from All Regulatory Responsibilities
Even if container houses are eligible for the exemption list, they still need to fulfill other approval and regulatory responsibilities:
- Compliance with Multi-field Regulations: It is not allowed to violate laws and regulations in fields such as fire protection, safety, urban appearance, property management, ecological environmental protection, and building use safety. For example, container houses need to be equipped with fire protection facilities and meet safety standards.
- Advance Communication and Consultation: It is advisable to communicate fully in advance with property owners and adjacent interested parties and consult with the local sub-district and relevant competent authorities on specific matters such as the setup of temporary facilities, fire safety, and noise management to ensure compliance.
Restrictions on Long-term Use or Commercial Purposes
If container houses are used for long-term residence or commercial activities (such as shops), they may exceed the scope of temporary facilities, and their legality needs to be further evaluated:
- Planning and Land Nature: It is necessary to confirm whether the land use of the residential community allows for commercial or residential purposes to avoid unauthorized alteration of land nature.
- Approval from Property Management and Property Owners: It is necessary to obtain the approval of the property management company and the property owners' meeting; otherwise, there may be a risk of complaints or demolition.
