Burglary in Container Houses

Admin 15 de septiembre de 2026

If a burglary occurs in a container house, the legal determination and handling are the same as those for ordinary residences, both classified as 'burglary' without being affected by differences in housing types.

Criteria for Determining Burglary

According to Article 264 of the Criminal Law of the People's Republic of China, burglary is a constituent element of a crime independent of the amount stolen. As long as the act meets the characteristic of 'unlawfully entering a living place that is relatively isolated from the outside world for a family and its members,' it constitutes burglary. Specifically, this includes:

  • Scope of Places: It covers enclosed courtyards, rented houses, tents, fishing boats, and other living places. If a container house is used for living and is isolated from the outside world, it also falls within the category of a 'dwelling.'
  • Behavioral Characteristics: With the intent of unlawful possession, forced entry through means such as prying windows or kicking doors. For example, in a case in Huichang County, Jiangxi, suspects pried open anti-theft windows and kicked in wooden doors to enter the premises. Even though they only stole 1.6 yuan, they were still determined to have committed burglary.

Legal Consequences and Sentencing Basis

Burglary does not have a monetary threshold and directly constitutes the crime of theft. According to the criminal law:

  • Basic Sentencing: Imprisonment for not more than three years, criminal detention, or surveillance, along with a fine or a single fine.
  • Aggravating Circumstances: If there are circumstances such as multiple thefts, theft with a deadly weapon, pickpocketing, or if the amount stolen is relatively large (usually more than 1,000 yuan to 3,000 yuan, with different standards in each province), the sentencing range will be increased to imprisonment for not less than three years but not more than ten years. If the amount is particularly large or there are other especially serious circumstances, the sentence can be imprisonment for not less than ten years or life imprisonment.

Typical Cases and Judicial Practice

  • Case in Huichang County, Jiangxi: Four suspects were criminally detained for burglary involving only 1.6 yuan. The police clearly stated that the harmfulness of burglary does not depend on the amount stolen but on the infringement of residents' living safety, so they took mandatory measures in accordance with the law.
  • Burglary at a Chicago Auto Dealer: Although it was a commercial establishment burglary, if the suspects entered a warehouse or office area isolated from the outside world by damaging doors and windows, it may be determined as 'similar burglary.' When sentencing, the amount stolen (such as 1 million US dollars) needs to be considered comprehensively.

Prevention and Response Recommendations

  • Physical Protection: Install anti-theft doors and windows, surveillance equipment, and reinforce the structure of container houses.
  • Legal Awareness: Residents need to understand the seriousness of burglary, report it to the police in a timely manner, and preserve on-site evidence (such as damage marks and surveillance footage).
  • Judicial Cooperation: Public security organs should give priority to investigating such cases. Even if the amount stolen is small, they should still maintain social order through measures such as criminal detention and pursuit.
