Container House Approval Procedures
Container houses require approval, and the approval procedures and processes are as follows:

I. Necessity of Approval
Although container houses are temporary in nature, they occupy public space and may involve commercial use, falling within the category of buildings. Therefore, they must be declared for approval in accordance with the law. According to Article 44 of the Urban and Rural Planning Law of the People's Republic of China, temporary construction within urban and town planning areas shall be approved by the urban and county people's government's urban and rural planning administrative departments. Unauthorized construction without approval may be identified as illegal construction and face the risk of demolition.
II. Approval Process
Site Selection and Land Property Confirmation
- It is necessary to confirm the land property (such as construction land, agricultural land, etc.) with the local land management department to ensure compliance with planning requirements.
- Sign a land use contract to clarify the usage period and purpose.
Planning Filing and Approval
- Bring the land planning documents to the local planning bureau to complete the filing procedures and submit the design plan for the container house (such as layout, height, appearance, etc.).
- After review and approval by the planning department, issue a Temporary Construction Project Planning Permit or relevant approval documents.
Design Drawings and Plan Formulation
- Design detailed drawings according to planning requirements, including structural safety, fire exits, water and electricity layout, etc.
- Formulate a complete construction plan, specifying materials, construction period, and safety measures, and submit it to the planning or construction administrative department for review.
Construction and Acceptance
- Construction can commence after the plan is approved, and it must be carried out strictly in accordance with the approved content without unauthorized changes.
- After construction is completed, apply for acceptance by the planning or construction department. Only after passing the acceptance can the container house be put into use.
III. Approval Requirements for Special Scenarios
- Commercial Use: If the container house is used for commercial or office activities, it is also necessary to complete relevant procedures such as business registration, fire safety, and environmental protection. For example, a prefabricated building project in Kunming required environmental impact assessment approval before construction.
- Validity of Lease Contracts: Lease contracts for container houses without approval may be deemed invalid. For instance, in a case in Yingkou, Liaoning Province, the court ruled the lease contract invalid because the container had not obtained planning approval.
IV. Precautions
- Compliance with Land Use: Ensure that the land property allows for temporary construction and avoid unauthorized construction on agricultural land or public green spaces.
- Safety and Environmental Protection: The modified container must meet safety standards such as fire safety and earthquake resistance, and some projects require environmental impact assessment approval.
- Duration Management: Temporary buildings usually have a usage period (such as 2-5 years) and must be demolished or reapplied for approval upon expiration.
