Container House Application Requirements

Admin 16 de septiembre de 2026

Whether a container house requires application for construction depends on its purpose, land nature, and usage scenario. Some cases require approval or filing, while others may be exempt. It can be divided into the following three categories:

1. Temporary, non-commercial use without altering land nature: Generally, no application is required, but specific conditions must be met. If the container house is only used for temporary storage (e.g., storing agricultural supplies and tools), and the ground is not hardened, no water or electricity is connected, no foundation is poured, and no permanent occupation is formed, it is generally not considered an illegal structure. For example, in 2024, a local natural resources bureau clarified that field container houses used solely for storing agricultural supplies without water or electricity connections are not classified as illegal structures. Additionally, in some regions, container houses for residential purposes can be legally installed if they are declared as formal buildings and obtain construction permits, but they must comply with height requirements (no more than 6 floors, total height ≤ 24 meters).

2. Commercial use or alteration of land nature: Application and relevant procedures must be completed. If the container house is used for commercial activities (e.g., homestays, shops), land approval, planning filing, and fire safety permits are required. For example, a company in Hangzhou legally installed container houses as staff dormitories after obtaining approval for prefabricated buildings, while a campsite owner in Yunnan was fined for operating a coffee bar in a container house on leased forest land without obtaining forestry fire safety approval. Furthermore, if the container house is connected to water and electricity, used for long-term residence, or repurposed for commercial use, it may be deemed a “substantial alteration of land use” and face demolition risks.

3. Policy differences across regions: Local regulations must be followed. Coastal cities (e.g., Shanghai, Shenzhen) are more accommodating toward container houses and have introduced special policies to encourage their use in cultural tourism and commercial sectors. In contrast, some agricultural provinces (e.g., a 2025 regulation in a certain province) require temporary building filings for field container houses, even if they are only used for storing farm tools. Additionally, container houses are strictly prohibited in basic farmland and ecological protection zones, as they may be classified as illegal structures.
