Can Prefabricated Houses Be Placed Arbitrarily?

Admin 18 de septiembre de 2026

Prefabricated houses cannot be placed arbitrarily.

Planning Approval Requirements

For temporary constructions such as prefabricated houses within urban and town planning areas, approval from the urban and county people's government's urban and rural planning authorities is mandatory. This is explicitly stipulated in Article 44 of the Urban and Rural Planning Law of the People's Republic of China. The urban and rural planning authorities will conduct a comprehensive assessment based on various factors, including the local urban and rural planning layout, land utilization, and urban development needs. Only construction applications that meet the relevant planning requirements will be approved. For instance, in historical and cultural districts or key urban development areas, the control over temporary constructions is stricter to avoid affecting the overall urban landscape and development plans.

Usage Duration Limitations

Even if the construction application for a prefabricated house is approved, it does not mean it can be placed permanently. It has a clearly approved usage duration, and after this period expires, the constructor is required to dismantle the prefabricated house themselves. This is to prevent temporary constructions from evolving into permanent buildings, thereby affecting the dynamic development and planning adjustments of the city. For example, temporary venues built for large-scale events in some cities must be dismantled according to regulations after the event ends to restore the site to its original condition.

Planning Permission and Land Regulations

In addition to meeting planning approval and usage duration requirements, the construction of prefabricated houses also requires obtaining corresponding planning permission. This means that constructors need to submit detailed construction plans to relevant departments, including information on the house's dimensions, structure, and purpose, to ensure compliance with local planning standards. Simultaneously, the construction land must also comply with the relevant provisions of the Land Administration Law of the People's Republic of China. Different land types have different usage requirements. For example, agricultural land cannot be arbitrarily used for constructing prefabricated houses; it must undergo legal land use change procedures to convert agricultural land into construction land before construction can proceed.
